We are thrilled to share a significant victory for our client, Zyxel Communications before the Federal Circuit. In a precedential opinion released Monday, the Federal Circuit affirmed the PTAB's final written decision on the obviousness of six of seven challenged claims of U.S. Patent No. 8,265,096 and reversed the PTAB’s non-obviousness determination of the remaining challenged claim. The court also instructed the PTAB to reassess the validity of proposed substitute claims in light of this decision. This patent has been asserted against ZyXEL by UNM Rainforest Innovations in district court. Our successful IP team for this case includes Peter Chassman, Jonah Mitchell, Jonathan Detrixhe, and Michael Forbes. Jonathan Detrixhe presented the oral argument. Unified Patent Court Roundup: first PI affirmance, another SEP settlement, #FRAND procedures, joinders, amendments, and more The previous general UPC roundup by ip fray was published two weeks ago. More recently there was a roundup article to discuss several appellate decisions. This roundup contains one appellate decision, but mostly orders and rulings by the Court of First Instance (Central Division, Local Divisions).
