Recently, the United States Department of Defense completed its regulatory review process, and the CMMC rule is expected to be published by mid-December this year. Once the DoD responds to public comments, the CMMC program will go into effect in Q1 of 2025. It's highly anticipated that the CMMC rule will be published as a "proposed rule," meaning it will go into effect after an agency responds to public comments in a final rule. There will likely be a multi-year phased-roll out, so all contracts will contain CMMC by 2028. It is critical to note that the implementation of cyber requirements may take longer than the completion of the rulemaking. In order to be prepared and reach compliance, DoD contractors and subcontractors should begin taking the proper steps to prepare their organizations. Recent revisions to 32 CFR § 236, “Department of Defense (DoD) Defense Industrial Base (DIB) Cybersecurity (CS) Activities” were published and made effective April 11, 2024. The Final Rule expands eligibility for the DIB CS Program from only contractors that possess an active Facility Clearance to all defense contractors who own or operate an unclassified information system that processes, stores, or transmits Controlled Unclassified Information (CUI).
