🔥 Hot gossip just in before the long weekend! 🔥 The Northern District of Texas has GRANTED a preliminary injunction to delay the FTC's non-compete ban. Here's why this matters: 1️⃣ A federal court just held that the Rule's challengers are "𝗹𝗶𝗸𝗲𝗹𝘆 𝘁𝗼 𝘀𝘂𝗰𝗰𝗲𝗲𝗱 𝗼𝗻 𝘁𝗵𝗲 𝗺𝗲𝗿𝗶𝘁𝘀" of their case. 2️⃣ The 5th Circuit Court of Appeals, known for its employer-friendly stance, will review this anti-FTC ruling. 3️⃣ Regardless of the 5th Circuit's decision, this case will likely join a series of non-compete cases SCOTUS will review next term. BREAKING NEWS from the Ryan v. FTC case out of the Northern District of Texas! "The Court sets aside the Non-Compete Rule. Consequently, the Rule shall not be enforced or otherwise take effect on its effective date of September 4, 2024 or thereafter." "Having concluded that (i) the FTC promulgated the Non-Compete Rule in excess of its statutory authority, and (ii) the Rule is arbitrary and capricious, the Court must “hold unlawful” and “set aside” the FTC’s Rule...setting aside agency action under § 706 has ‘nationwide effect,’ is ‘not party-restricted,’ and ‘affects persons in all judicial districts equally.’” More to follow. #FTC #noncompete #employmentlaw

Important point re yesterday’s FTC action regarding noncompetes. This ban is not yet the law of the land. If you are a party to a noncompete, yesterday’s action does not render your agreement unenforceable. The rule will go into effect 120 days after it is published in the Federal Register and there very well could (and probably will) be legal challenges. Stay tuned.
