BREAKING NEWS from the Ryan v. FTC case out of the Northern District of Texas! "The Court sets aside the Non-Compete Rule. Consequently, the Rule shall not be enforced or otherwise take effect on its effective date of September 4, 2024 or thereafter." Important point re yesterday’s FTC action regarding noncompetes. This ban is not yet the law of the land. If you are a party to a noncompete, yesterday’s action does not render your agreement unenforceable. The rule will go into effect 120 days after it is published in the Federal Register and there very well could (and probably will) be legal challenges. Stay tuned.
