Are we going to be looking at the Wild Wild West or a big nothing burger? FTC's ban on non-competes is effective September 4. Conventional wisdom is that is will be enjoined by a Texas District Court when the court issues a final decision on requested nationwide injunctive relief by August 30. "Conventional wisdom" also was that the ban would be enjoined a while ago - which didn't happen as the Texas Court declined to issue a nationwide injunction. If the ban is effective even for a short time then it will be very interesting to watch the different strategies used by companies and industries in dealing with it.
