Capitalizing Attorney's Fees: A Tax Strategy for Property Cases Occasionally, the tax system offers a strategic move that can alleviate financial pressure. One such maneuver involves capitalizing attorney's fees in cases of property-related disputes. If you find yourself seeking recovery for property damage or loss, the pain of incurred attorney's fees can be reduced. These costs could be added to your property's basis, effectively reducing any taxable gain from the transaction. For instance, if you receive a $300,000 settlement for property destruction, with $100,000 attributed to legal costs, and your basis in the property is $200,000, you can adjust the basis to include legal fees. This way, you can try to limit gain and soften the tax impact. It's a tactical approach, one that requires careful consideration and, often, professional guidance to determine if your situation qualifies. #kimandrosadollp #taxlawyer #tax #settlement #attorneysfees

As I'm nearing the one year anniversary of being a lawyer, I think's also appropriate that I'm also now starting to see real results for the clients of Taxpayer Law. The world of tax does tend to move slowly. In just the past few weeks I've accomplished the following: (1) Reduced a client's tax liability on a director's liability assessment from $1,800,000 to $0 with a single submission to the CRA; (2) Successfully objected to a reassessment that denied a client the $24,000 GST/HST New Housing Tax Credit; and (3) Completed a reorganization of a privately held corporation worth $1,000,000 at an amount notably less than originally quoted. While I'm new to the world of tax and even newer to the world of tax litigation, it feels good to know that I have the capacity and ability to produce demonstrably positive results for our clients.
