📢 Important Update on Parole in Place Program The temporary stay on the new Parole in Place program, designed to benefit spouses and stepchildren of U.S. citizens, was scheduled to be lifted today, September 9th. However, a new extension has been announced, keeping the stay in effect until at least September 23rd. This means that any benefits or applications under the program will remain paused for the time being. It seems that the Biden-Harris administration is making the parole tool the best way to introduce by fiat an “executive amnesty” for spouses of U.S. Citizens using the president’s executive order power, authorizing immigration agencies to issue parole in place to U.S. citizens’ spouses in order for them to apply for a green card. Many mix-status families have individuals who can’t adjust status after being living in the U.S. for many years. This policy strategy, seems to be the best option to keep the border security measures untouched, in order to keep at bay his right-wing critics within his own party. Executive Orders can be tricky, because they depend on his reelection to remain in place for longer time. We already know what happened with DACA, though. Yet, after United States v Texas it seems that it won’t violate constitutional separation of powers, an amnesty is still limited in time. Is a band aid, the system needs a deep reform, but if the EO is issued to grant parole to spouses as it was announced yesterday it could be life changing for many immigrants.

The new parole-in-place policy announced by President Biden aims to assist undocumented immigrants who are spouses of U.S. citizens. NOTE: This policy is not yet accepting applications. This policy allows these individuals to apply for an adjustment of status without having to leave the country, a process that often causes fear and uncertainty. Previously, this was only an option open to spouses of military members. Typically, undocumented individuals would have to leave the country and apply for a green card at a U.S. embassy in their home country, which could take a significant amount of time and result in hardships. Some would resort to applying for a 601A waiver, but this process also takes years and leaves them without a legal way to work while their application is processing. The new policy is a significant improvement as it speeds up the process for these individuals to obtain legal status, thereby reducing the time they are separated from their families and allowing them to work legally sooner. This change is crucial in providing a more efficient and compassionate pathway to legal residency for undocumented immigrants married to U.S. citizens.
