Alluring EU AI Act has been published in the Official Journal of the EU on July 12 , 2024 by bringing complex and relatively brain-twister questions regarding its enforcement not only for EU markets but beyond. Besides the EU markets, third countries also need to make "a compliance to-do list". White & Case LLP team has simplified this puzzling compliance and enforcement journey with "EU AI Act Enforcement Timeline." Certainly deserves a peek. #AI

🌐 Exciting News for the Legal Community! 🤖🇪🇺 The European Union has officially given its unanimous approval to the world's first comprehensive rulebook for Artificial Intelligence. The EU AI Act is landmark legislation, regulating AI based on its potential harm and including a tiered approach addressing powerful AI models, with horizontal transparency rules for all and additional obligations for models posing systemic risks. From opposition to consensus, the legislative process shows the challenges of policymaking in the digital age. As a law firm, we are engaged in mandates reflecting the AI Act's emphasis on transparency, protection of trade secrets, and the reassessment of criteria for designating AI models with systemic risks, among many other things. The establishment of the European Artificial Intelligence Office signals a proactive approach to overseeing AI models. Interesting article, and conclusion: let’s hope that’s indeed the case for the SEP regulation ! SEPs are a low-priority topic for the EU compared to AI. There’s a very strong desire to pass the AI Act into law before the end of the term. The SEP Regulation will apparently be carried over into the new term. At that point, Mr. Breton won’t be in charge. If the Council and the Parliament can’t work it out, the Commission might just withdraw the proposal. Unthinkable for the AI Act, but not for the SEP Regulation.
Interesting parallels between EU AI Act and EU SEP Regulation: Council as voice of reason SMEs. Open source. Commissioner Breton auditioning. Disregard for legal limits. Calls for another EU competence center (for AI, the Parliament even wanted a whole new agency). https://lnkd.in/ddX5E6Xc

The European Parliament has given its final approval to the far-reaching EU Artificial Intelligence Act. This significant move comes after much consideration and debate, with 523 lawmakers backing the legislation and only 46 opposing. The new law will mitigate potential risks associated with AI's exponential growth while nurturing a climate conducive to innovation. With the emergence of powerful systems like ChatGPT, the need for comprehensive legislation has become increasingly urgent, sparking a race to establish regulatory frameworks. The new law must still be formally endorsed by the European Council and is expected to be finally adopted before the end of legislature in May 2024. Under the AI Act, stringent measures are in place to address varying levels of risk associated with AI applications, with outright bans on tools deemed most threatening. High-risk AI providers must undergo rigorous assessments and ensure compliance with the law before introducing products to the public. Fines for violations range from €7.5 million to €35 million, emphasizing the gravity of adherence to these regulations. Organizations that develop or employ AI must take heed and ensure that they are ready when this new law takes effect. #EUAIAct #ArtificialIntelligence #AIRegulation #InnovationEthics
