This July, as we celebrate Pride Disability Month, let us also be more aware of situations and mindsets that perpetuate ableism. Today marks the 34th Anniversary of the Americas with Disabilities Act of 1990 (ADA). The ADA, signed into law on July 26, 1990, was a landmark piece of legislation that broke down barriers to inclusion, but people in the disability community still experience discrimination, social stigma, and marginalization. Lifeworks recognizes the important role the ADA continues to play in ensuring greater access and opportunities for people with disabilities – but we know there is still more work to be done. Everyone, especially legal spaces, will usually hop on the bandwagon of inclusion discussions but they will absolutely ignore disability as a concept or as a topic for inclusion. (note, I said discussions, not actions, let's leave the actual implementation of changes with respect to race and gender etc. for another day or I'll explode) I don't think I've ever heard more eugenics thinking and than in legal spaces. An absolute, resolute, unwillingness to pretend disability exists. Or, seeing disability as a weakness or a moral failing. There is an unwillingness to accommodate. An unwillingness to acknowledge that disabled people out there, working and living and having messy or simple legal disputes just like everyone else. That they belong as clients and as members of the profession. 27% of Canadians over 15 have a disability. The legal profession has few disabled lawyers, as most are driven from practice - driven from even applying to law school in the first place. It's, frankly, gross. Inclusion discussions should include disabled people. Full stop. From a hiring perspective, firms miss out on talented, extraordinary lawyers who absolutely belong in this profession. From a client perspective, accommodation is essential. Disabled people also face increased access to justice barriers, across all types of law. We're well past the time when this reckoning needed to happen in legal spaces. Decades past. And now, post pandemic, accommodation discussions seem to somehow be getting worse? Saddening. Maddening. Anyway, shout out to Kadey Schultz, LL.B. LL.M. CRM who 100% always "gets it" and who is willing to go to bat for disabled people every day, inside her practice and out.

I see a recurring trend in disability inclusion: doing the bare minimum to avoid lawsuits. This approach, while legally sufficient, fails to foster a truly inclusive and supportive environment for individuals with disabilities. Let’s move beyond the minimum and commit to creating an environment where everyone can succeed.
