What happened at yesterday’s Renter’s’ Rights Bill debate? What you need to know 👇🏾 > The rent in advance amendment – limiting rent -in -advance requests to one month – was voted through. This is a big win for renters and a reflection of the dedication of our campaigners 🎊 > Many MPs spoke out about the need to stabilise rents, including Alex Sobel, Paula Barker and Bell Ribeiro-Addy. While, disappointingly, the government has not committed to the amendment, support across the board is a huge boost for the campaign 💪🏾 > Two amendments, one on creating a strong – and detailed – landlord register, and one on restricting unreasonable guarantor requests were also discussed at length, with MP’s sharing evidence from their constituents. The government committed to look at these areas further – an important step forward. Ending section 21 no-fault evictions continues to be a key part of the bill. In short, we’ve got some amazing wins under our belt. And we’ve made some great ground on guarantors, limiting rent increases and a strengthened landlord register. Renters' Rights day! The Bill will have its First Reading in the House of Commons, shortly after 12.30pm. The Bill will be presented, the long title read and an oral vote taken to proceed to Second Reading. The Speaker will ask when this is to happen and the presenter will say tomorrow. Ignore this as they always say that, but we will need to wait for the Leader of the House to announce a date. It will be over in a blink! A Business Statement takes place tomorrow as usual so we will see if a date is allocated. If not the House goes into recess until 7th October for Conference Season. Expect a fairly rapid passage through the Commons though as the Government has a big majority. The long title of the Bill, gives a clue about what will be in the Bill but we know there will be other measures such as redress a database and a rental standards. "Bill to make provision changing the law about rented homes, including provision abolishing fixed term assured tenancies and assured shorthold tenancies; imposing obligations on landlords and others in relation to rented homes and temporary and supported accommodation; and for connected purposes" An order to print the bill will be made, however this has already taken place and the bill can then be officially released. As soon as the published bill is on the Parliament website we can start dissecting it. The Renters Rights Bill. Positives ➕ 🟡 Increased tenant security - Landlords would no longer be able to evict tenants without a specific reason 🟡 New ombudsmen service - This would help resolve disputes and reduce the need for costly legal proceedings 🟡 Improved living conditions - Rental properties would need to meet a minimum standard Negatives ➖ 🟠 Reduced supply - Will this discourage landlords from entering the rental market thus leading to a lower supply? That could put upward pressure on rental prices 🟠 Reduced flexibility for landlords - Having to evict for a specific reason could limit the landlord's flexibility for example, they may need to move in themselves 🟠 Increased costs for landlords - Linked to point one, it's good that housing should meet better standards but this will increase the cost for landlords. We welcome the new legislation to ban no-fault evictions being introduced by the government in the commons today, which will give greater legal protection to the eleven million people in England who rent their homes. The Renters Rights Bill proposes the following: *Ban on no-fault evictions by ending Section 21 evictions that allow landlords to evict tenants without providing a reason. *An end to mid-tenancy rent hikes, rent increases will only be permitted annually at the market rate. *Landlords will be barred from discriminating against tenants based on benefits or children. *Tenants will have the right to keep pets in their rented homes. *Landlords will be required to address issues like damp and mould promptly, with a new “decent homes standard” applied to private rentals. *Landlords must publish rent prices and are prohibited from encouraging bidding wars. The proposed Renters Rights Bill represents a significant shift in tenant protection and housing regulation. The government’s new Renters’ Rights Bill is set to be introduced to Parliament today, 11th September 2024. The bill was first announced in the King’s Speech on 17th July, when King Charles III announced the government’s intention to introduce a new Renters’ Rights Bill, to give greater rights and protections to people renting their homes. The key changes set to be introduced by the bill include the ban on section 21 no-fault evictions for new and existing tenancies, extending Awaab’s Law to the PRS, and ending blanket bans for those on benefits or with children. “There can be no more dither and delay — we must overhaul renting and rebalance the relationship between tenant and landlord," said the deputy prime minister Angela Raynor. Commenting on this, Ben Beadle, chief executive at the National Residential Landlords Association - NRLA, said: "While we await the precise details of the bill, it is vital that it works, and is fair, to both tenants and landlords." Timothy Douglas, head of policy and campaigns at Propertymark, added: "While Propertymark acknowledges the drive towards improved standards, the UK government must fully understand and recognise the impact that these changes will have with agents up and down the country left wondering how this legislation will help meet the much-needed demand for homes for people to rent." It looks like the Renters' Rights Bill will be introduced into Parliament next week with more substantive debate in October after the party conference recess. The key change to the previous Government's Renters (Reform) Bill is the end of Section 21 evictions will happen immediately when the Bill becomes law, rather than waiting for improvements to court processes. This will be of concern to landlords who are likely to be concerned about how long it will take to evict tenants when they need to. Other measures in the Bill are expected to include: - The right for tenants to request to have a pet. - Greater rights for tenants to challenge rent rises. - Rules to prevent "bidding wars" for available properties. - Expanding "Awaab's Law" to the private rented sector Other reports today suggest landlords are selling properties due to potential capital gains tax increases. The implementation of all these changes, and others including Minimum Energy Efficiency Standards, need to be well coordinated to help keep a thriving private rented sector.

Renters Rights Bill to be published today! So the reincarnation of the Renters Reform Bill 'with steroids' is being published today, with the much heralded (by some) ban on Section 21 so called 'no-fault evictions' as its centre piece. The most concerning part reading this mornings news stories is that it seems ministers will not be addressing the impact of removing the relatively straight forward Section 21 process on the courts before the Bill becomes law. Instead they are planning to bring the ban in immediately the Bill is passed. Under this Bill's predecessor, the previous government and landlord groups were very rightly concerned about whether the court system could cope with the influx of cases that will now have to be physically heard before a Judge - and I think we all know the answer to that. Nothing has changed so could we be facing a rocky road of even more excessive delays and uncertainty for landlords and tenants? And if that isn't bad enough, a few stories this morning also suggested notice periods could be extended from two to four months. Not helpful to a landlord reliant on the rent to pay their mortgage each month when a Tenant stops paying. Oh well, at least it gets the Winter Fuel Payment headlines off the front page 🤔 #landlordinsurance #rentersrightsbill #addeptinsurance
