The Draft Environmental Impact Statement, or DEIS, looks at the environmental impacts of the proposed project and measures to lessen the environmental impacts. "We are writing in response to your environmental information request, made ahead of tomorrow’s sunshine notice for the Commission’s May 2024 meeting. To date, our team has worked diligently to meet or exceed every request made by the Commission and will continue to do so. Your decision to issue yet another eleventh hour data request this afternoon based on an unverified claim from a known opponent to the project does nothing but introduce the potential for further delay and encourage further baseless claims that the Commission has historically dispensed with. In any event, attached please find our response to your latest request; we believe it squarely addresses your questions.... As you know, it has been nearly ten months since CP2 LNG received its positive final environmental impact statement (FEIS), making it the longest LNG project to ever await a commission vote. According to today’s media reports, Chairman Phillips recently stated regarding CP2: “When this project is ready, we will vote it out. We have approved projects, and we continue to approve those matters that are properly filed and pending before FERC.” Respectfully, CP2 has been properly filed and ready for approval for many months, however, as always, we are committed to being responsive to every request made by the Commission..." Clean Air Victory! In a Victory for Clean Air Advocates in Texas, U.S. Court of Appeals Halts Sempra Energy Natural Gas Export Facility A federal court yesterday halted the construction of a massive liquefied natural gas (LNG) terminal planned for southeast Texas, ruling that Texas regulators failed to follow the federal Clean Air Act in issuing a permit authorizing the construction of Sempra Energy’s Port Arthur LNG project. The decision by the United States Court of Appeals for the Fifth Circuit, based in New Orleans, was a major victory for community advocates and environmentalists, who challenged the state-issued air pollution permit for the LNG terminal because it would release tons of health-threatening air pollutants into a community that is about two thirds Black or Latino and already overburdened by pollution. “This decision from the U.S. Fifth Circuit Court is welcomed, but it is no surprise,” said John Beard, Executive Director of the Port Arthur Community Action Network. “Every step in this fight, we’ve won by standing up for Port Arthur communities of color to breathe free from toxic pollution. 𝘾𝙖𝙡𝙞𝙛𝙤𝙧𝙣𝙞𝙖 𝙁𝙧𝙖𝙘𝙠𝙞𝙣𝙜 𝘽𝙖𝙣 𝙉𝙚𝙖𝙧𝙨 𝙁𝙞𝙣𝙖𝙡𝙞𝙯𝙖𝙩𝙞𝙤𝙣 California is on the brink of finalizing a ban on hydraulic fracturing (fracking) as the state's oil and gas regulator submits the final regulations to the Office of Administrative Law. This marks the culmination of over a decade of advocacy by public health and environmental groups. The regulations will take effect on October 1, 2024. 𝑲𝒆𝒚 𝑷𝒐𝒊𝒏𝒕𝒔: The ban is a result of persistent advocacy by frontline communities and environmental organizations. The regulations aim to prioritize public health and environmental safety over oil company profits. A new health and safety law also prohibits new oil and gas permits within 3,200 feet of sensitive sites like homes and schools. The California Geologic Energy Management Division (CalGEM) is under scrutiny for lax enforcement of new laws and for rushing through well approvals. The Current Administration Declares War on the U.S. Oil and Gas Industry. With US oil production reaching historic levels in 2023, the administration is trying to destroy the oil and gas industry to score points with anti-fossil fuels NGOs and climate activists. by Ed Ireland, Apr 13, 2024 Quote: - It is increasingly evident that the administration has adopted a “scorched earth” approach to the oil and gas industry because it has been unable to slow oil and gas production in the U.S., even with its over 200 regulations. Luckily, time is not on their side, with the presidential election only seven months away. Even so, the destruction they can do in that short period could be enormous.

This week, a deal was reached between Colorado state senators and the Oil and Gas Industry. The agreement is aimed at creating a compromise that will avoid dueling ballot measures in the November election. As a part of the agreement, the legislature will pass two bills: "one that will fund efforts to cap abandoned and low-producing wells to prevent them from leaking greenhouse gasses and set new emissions reductions targets in state law (and) one that will impose a new fee on every barrel of oil produced in Colorado that will fluctuate based on market prices but generate an estimated $138 million a year."
