Recent decisions of the apex courts in Singapore and India provide an opportune time to revisit this issue and the limits to the doctrine. 🚧 This article, written by our International Dispute Resolution team (Partners Akshay Kishore and Shaun Lee, FCIArb, Senior Associates Mark Ng, Adly Rizal and Yan Xun Asher Chin, Associates Wan Ling Lee and Lieu Kah Yen), delves into the intricate details and aims to help you understand the boundaries of this fundamental principle. Sundra Rajoo, Asian International Arbitration Centre discusses the evolving landscape of arbitration in #Asia, particularly in #India. Traditionally, ad hoc arbitrations with retired judges were preferred by Indian parties, but there has been a shift towards institutional arbitration, encouraged by initiatives from Indian authorities. Foreign institutions, such as the Singapore International Arbitration Centre (#SIAC), have seen a growing number of cases involving Indian parties, indicating a willingness to embrace administered arbitration by credible institutions. This trend may reflect a certain lack of confidence in Indian arbitral institutions, potentially influenced by the slow litigation process in Indian courts. Despite this, recent legislative efforts in India aim to enhance the efficiency and speed of the arbitration process.

Settlement in international arbitration is a trend no doubt, but it can be tricky indeed. That is why ICC Arbitration has prepared a very useful guide on “Facilitating settlement in international arbitration”. I invite my contacts to download it here https://lnkd.in/gG69wVdY and read it, in order to get a very good sense of what should we arbitrators, think and do in this matter. Don’t forget to send your comments once you read it! Patrícia de Figueiredo Ferraz Ana Serra e Moura
