ISDS mechanisms are commended for supporting international investments, but they are also criticized for compromising national sovereignty and inhibiting important regulations in areas such as environmental and public health protection. These systems often result in significant costs, especially for developing countries, leading to the diversion of resources from public services. This situation raises issues of fairness and concerns about the influence of multinational corporations over the public interest.
In a lecture in Miami, Alexis Mourre has suggested the arbitration community is "losing" the fight to ensure the survival of ISDS, endangering the future of commercial arbitration in the process, and should instead contemplate a return to the contractual protection of investments. Alison Ross reports.
