Four Ways to Prove Brain Injuries Are Serious and Worthy of Compensation 1. A life care planner with brain injury experience can create a picture of future care needs for your client. Some life care planners have obtained certification in this area. A Certified Brain Injury Specialist (CBIS) is a healthcare professional specializing in the care and rehabilitation of individuals who have experienced brain injuries. 2. Demonstrative evidence can be very helpful to show what has happened in the brain at microscopic levels. Prominent San Francisco torts lawyer, Melvin Belli believed the most important task in every case, was to make use of demonstrative evidence to show the way to a successful result and never to just tell anything that could be shown also. Use diagrams of the brain, models of how the brain works or videos to explain the injury. For examples of how video can be used effectively to showcase brain injury, see the Portfolio section of the website of DK Global (dkglobal.net). 3. Your experts will need to explain that the injuries will likely continue to affect your client for the rest of her life. Specifics as to how her life will be affected are invaluable. Much solid research is to be found in medical literature and this can be obtained by an experienced legal nurse consultant or other medical professional and included in your doctor’s reports. For example, according to a report by forensic neuropsychologist Dr. Timothy R. Kockler, PhD, traumatic brain injured patients are at a higher risk for emotional and behavioural disturbances. Dr. Kockler cites a study of TBI patients by Leon Carrion et al. (2009) which found that: “... 48.6 % of traumatic brain injured patients fulfil the criteria that classifies them as depressive and of these, 65% are at clinical risk to commit suicide (33.3 % of the total of TBI patients)....” Dr. Kockler provided additional support with a study from Tsaousides et al. (2011) which concluded “[i]ndividuals with TBI from all demographic groups and with injuries of varying severity are at risk for SI [suicidal ideation] and thus for emotional distress and suicidal behaviour.” Dr. Kockler’s research also found TBI patients to be at greater risk of seizure activity, citing Annegers and Pasternak-Coan (2000) which found that the relative risk of seizures after TBI to be 1.5 after mild injuries, 2.9 after moderate injuries and 17.2 after severe injuries. Significant risk factors included brain contusion, subdural hematoma, skull fracture and loss of consciousness. 4. A vocational consultant can provide an employability evaluation and income capacity evaluation which will allow a projection of future lost income.
