34 years ago today, the Americans with Disabilities Act was signed into law. The ADA provides basic protection for disabled people from discrimination based on disability, primarily focused on accessibility. While the ADA was monumental in establishing guidelines for accessibility, there are many gaps that have left disabled people with inequities in healthcare, employment, and marriage rights, and more. In the subsequent years, many disabled activists have been working towards a more inclusive, comprehensive, and intersectional #DisabilityJustice movement. Today, focus on centering disabled stories — not just those of hardship and activism, but also those highlighting everyday #DisabledJoy. #DisabilityRights #ADA34

National Disability Independence Day occurs every year on July 26, commemorating the anniversary of the Americans with Disabilities Act (ADA), which protects people with disabilities from discrimination of all kinds. Under the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act (Section 504), public schools cannot exclude students with disabilities, deny them equal access to their education, or segregate them unnecessarily. They are also obligated to provide reasonable modifications to policies, practices, and procedures to give students with disabilities an equal opportunity to benefit from their public education. During the pandemic, this access to equal opportunity was in jeopardy. In 2022, the parents of 12 Virginia public school students whose disabilities make them vulnerable to COVID-19 filed a federal lawsuit challenging Governor Youngkin’s Executive Order 2 and Senate Bill 739, which stripped school districts of the ability to require community masking as a COVID-19 prevention measure. Represented by the ACLU of Virginia, the Washington Lawyers’ Committee, Brown Goldstein & Levy, the disAbility Law Center of Virginia, and Arnold & Porter, the parents won a preliminary injunction and eventually settled with the state: Virginal public schools must make accommodations under federal disability law if a child with a disability requires peer and teacher masking—regardless of the requirements of Executive Order 2 and Senate Bill 739. Students with disability in Australia are protected by the Disability Discrimination Act 1992 (DDA) and the Disability Standards for Education 2005 (DSE). The DDA protects people from being discriminated against because of their disability. The DSE explain the rights of students with disability and what education providers must do to support and protect students with disability. 🎉 Happy National Disability Independence Day! 🎉 Today, we celebrate the rights and independence of people with disabilities and commemorate the signing of the Americans with Disabilities Act (ADA) in 1990. The ADA ensures access to public establishments, transportation, communication, and government services, prohibiting discrimination based on disabilities. Did you know? One in four adults in the U.S. has a disability (CDC). Three out of four people with disabilities experience some form of abuse (NCADV). People with disabilities are 4-10 times more likely to be victimized than those without disabilities (CDC). Children with disabilities are 4 times more likely to experience abuse (BBC). Disabilities can affect mobility, hearing, vision, cognition, communication, and mental health, creating opportunities for abusers to exploit. These challenges may prevent some victims from seeking support or recognizing the abuse they experience. Additionally, domestic violence can cause disabilities through physical injury or mental health issues.
