Supreme Court ruling upholding CFPB funding as constitutional I had posted a few months ago about the interesting voting dynamics developing at the SCOTUS and particularly the linkage between Chief Justice Roberts and Justice Barrett potentially joining the three "liberal" Justices (Sotomayor, Kagan, and Brown Jackson) to frame at least a 5-4 decision in administrative law and other cases, and possibly having Justice Kavanaugh join as well for a 6-3 decision. I suggested that those in the banking/financial services arena keep an eye on those current voting dynamics given the pending cases remaining at the court. Well, the voting pattern in the CFPB case upholding the agency funding mechanism broke along those lines with the added bonus of Justice Thomas writing the majority opinion and breaking away from the conservative bloc of Justices Alito and Gorsuch. The CFPB case was decided on a 7-2 vote with a Thomas majority opinion and concurring opinions from Kagan, and Brown Jackson. Alito filed a dissenting opinion, joined by Gorsuch. This decision should put to rest further challenges to the constitutionality of the CFPB funding processes. Of course, a future Congress could amend the funding process and subject the CFPB to a different appropriations process. #SCOTUS #CFPB #Banking agency #Constitutional Challenge #banks #consumer credit

Only about 2%-3% of members use Overdraft Privilege (Courtesy Pay). The reason they use it is because they need it (just ask them). If we don't offer OD their checks will be returned, their debit card transactions will be denied, and their ACH payments returned causing problems with their other creditors. And they will turn to the old ways of bad payday lenders that actually cost more than OD. NCUA jumping on board with the CFPB and fighting to remove this service for members will hurt 100% of consumers. That's right, this is not a good thing for consumers. Why? If banks and CUs can't use OD fee income, what do you think will happen? Banks and CUs will be forced to 1) Increase Loan Rates, 2) Decrease Deposit Rates, 3) Increase or Add new fees to compensate for the decrease in OD fees. These three unintended consequences aimed at helping the 2% to 3% customers/members, will increase costs on 100% of bank and credit union account holders. While cloaking this bad regulation as "consumer friendly" it will end up costing every banking customer and member across the country more in fees, more in loan interest, and less in dividends/interest earned on deposits. You can include the Credit Card Competition Act and reducing interchange income as well. Banks and CUs will have to recoup the income from somewhere in order to pay for Fraud, Regulation/Compliance, and Technology. If I'm wrong, please tell me how. I depict how the forces of evil allied, joined forces, and wrapped around me like the arms of an octopus wrapping around its prey to devour it. I also embody the extent of my suffering that melted in the crucible of injustice, where there are mali- cious machinations, satanic tricks, and administrative cor- ruption. For example, they made legal fallacies, suspended my salary, deprived me of health insurance, let university employees manipulate me, took arbitrary measures against me, constantly persecuted me, and tried to get rid of me without human motive for racist reasons that no human mind can imagine. They would harm my dignity as an Ameri- can citizen. They also work to destroy the societal value system as a whole. All this and more is detailed within the pages of this book

2moI have applied for 10 different positions with SRP, mostly Member Services. I have been interviewed for 5 of those positions and have been passed over for each. The other 5, I received an email stating they are pursuing other applicants. I guess I'm good enough to be a member but not an employee.
