The right to property, protected by Article 13 of the Federal Constitution, ensures individuals are not deprived of their property without due legal process and guarantees adequate compensation, especially during compulsory land acquisition by the state. But what happens when buildings are erected contrary to designated land use? Can landowners still claim compensation? The Federal Court case of MMC Tepat Teknik Sdn Bhd v Pentadbir Tanah Daerah Klang & Anor and other appeals [2023] 5 MLJ 520 sheds light on this issue. For over 25 years, MMC Tepat Teknik operated its steel fabrication plant, office block, store, and guardhouse on land designated for agriculture and heavy industry. When the land was acquired for the West Coast Expressway Package 3 project, disputes arose over the Land Administrator's compensation for these lots. The Federal Court clarified that while Article 13 of the Federal Constitution guarantees adequate compensation, buildings on misused land aren’t eligible. According to Para 1(3A) of the First Schedule of LAA 1960, buildings erected against land use conditions - like industrial buildings on agriculture or residential land - are ineligible for compensation. The Federal Court highlighted that MMC Tepat Teknik’s buildings on Lots 1604 and 1608 breached the National Land Code and zoning laws and, therefore not eligible for compensation. This decision sets a clear precedent for future land acquisition cases, underscoring the importance for landowners to adhere to designated land use conditions to safeguard their rights and interests. It serves as a reminder that adherence to planning and zoning laws isn’t merely a legal formality but a crucial step, even when constitutional property rights are at stake.

Big news today from the Department of the Interior, which modernized its bonding program to reduce future orphan well burden on public lands, which account for ~10% of U.S. O&G production. The new rule raises the minimum on single well bonds to $150k and statewide bonds to $500k, and eliminating nationwide blanket bonds. This measure will help ensure that more wells on public lands, especially in the Rocky Mountain states, are plugged in a timely fashion at the end of their useful lives: https://lnkd.in/eJ48YMfB

The new Land Reform Bill in Scotland has sparked significant interest with its proposed changes in land ownership. Since its introduction in March 2024, the media has been abuzz with discussions on the regulation of "large landholdings." As the initial frenzy settles, the question arises - what will be the true impact of these changes?
