It is time for part 2 of Rebecca Boartfield's "Common Practices fraught with Risk." "Keep in mind the following regarding internships. In order to have an intern who is not compensated, the FLSA states all of the following criteria must be met: 1. The training, though it may include the actual operation of the employer’s facilities, is similar to training that would be given in a vocational school; 2. The training is for the benefit of the student; 3. The student does not displace regular employees, but works under close observation; 4. The employer who provides the training receives no immediate advantage from the activities of the trainees or students and, on occasion, his/her operations may even be impeded; 5. The student is not necessarily entitled to a job at conclusion of the training period; and 6. No one should work for free. I have heard stories where so called 'agents' are offering international engineers unpaid internships for a fee of $5,000. Just makes me feel sick! It's unfair and unreasonable. Under Australian law, unpaid internships are only lawful when: The intern is not performing “productive” tasks, and the placement benefits the individual more than the organisation. As an industry we need to advocate for fair treatment in the engineering workplace. By understanding the difference between legitimate internships and exploitative practices. Speak up.

My Internship 20 Years Ago About 20 years ago, I embarked on a summer internship at the Department of Justice. Back then, their office was located in the Queensway Government Offices. I was part of a team of over 10 lawyers. My seat was in a secretarial pool without windows. With mobile phones having only primitive functions at that time, there were few distractions. Sometimes, I felt lost in time 😵💫, unable to tell if the sun had set. Everything and everyone was new to me. One senior lawyer from another team particularly caught my attention. She often worked overtime. She was an expat in her 50s, and despite her seniority, her office had no windows—a choice that puzzled me 🤔. Sharing the office with secretaries gave me access to unofficial insider information. I learned that this senior lawyer worked tirelessly, sometimes forgetting to leave the office. She possessed qualities that I still admire today: 1️⃣ Humility - “Humility is having the self-esteem to understand that even though you are doing well, you do not have to brag or gloat about it.” [1] 2️⃣ Hard working - Actions speak louder than words. Hard work is a virtue best demonstrated, not just talked about. 3️⃣ Perseverance - "It's not that I'm so smart, it's just that I stay with problems longer." [2] 4️⃣ Leading by Example - “Leading by example inspires trust, fosters a healthy work culture, and discourages toxic behavior.” [3] I’m amazed that, as an intern, these bits and pieces have stayed with me for so many years. Law students, you don't need to pay for internships. If you're struggling to find a good one, remember: paying for an internship is never the answer. Interns are supposed to be paid a stipend for their work, not the other way around. No reputable organisation will ask you to pay for a law internship.
