The spotlight is set to be turned on Australia's corporate whistleblowing regime - which last underwent significant reform in 2019 - with a statutory review due after 1 July this year. Investigating whistleblower complaints can be complex undertakings governed by strict legislative requirements where the statutory protections apply. When an employee decides to "blow the whistle” on corporate wrongdoing and an investigation is launched, the investigator appointed is duty bound to conduct a fair and impartial investigation, while complying with any statutory whistleblower protections that may apply, including protecting the identity of the discloser. An investigator not only has an ethical duty to conduct a procedurally fair investigation, but also one that is trauma-informed and seeks to minimise any negative impacts on participants. The whistleblower may have already experienced trauma, including during the decision-making process to lodge a complaint.
