I've not yet read this decision but it is, if as stated in this post, completely outrageous and inappropriate. There is often no-one better able to represent the client than their own attorney, who will know the case inside out and truly understand the commercial imperatives. Not least, they will bear the most onus for knowing the relevant law etc so as to ensure the best chance of the right outcome for the client. Since the qualifications of in- and out of-house #PatentAttorneys are usually the same (particularly in UK), what possible motivation can there be for this decision - more 'jobs for the private practice people' and more expense in terms of both money (and often time) for the client? OK, rant over; now I'll go and read the decision in detail, but I'd love to see (informed) comment from other in-house folk who are currently in practice and the professional bodies, and who have read the decision/will be affected by it. #upc #patentattorney #inhousecounsel #inhouse #corporate The Chartered Institute of Patent Attorneys epi
