This morning, I read the news on the Australian Broadcasting Corporation (ABC). The first headline caught my attention: "'Litigate you to death': Gas giant uses new tactic which sink environmental dissenters." The article concerned aggressive environmental litigation tactics deployed by fossil fuel giant Santos and its lawyers Quinn Emanuel. The issue: Santos sought cost orders against third parties who supported public interest environmental litigation morally, for example by liking a post. At its core: the inequality of weapons -- here, a multi-billion dollar company and a global law firm specialising in large-scale commercial #litigation and #arbitration; there highly under-resourced public interest defender offices and cash-strapped public interest groups and #NGOs. While reading the article, I realised again how topical our Panel III on Mediating Complex Environmental Disputes really is. In these often poly-centric, multi-party, high-stakes and complex disputes, mediation can make a real difference to generating real solutions that promote all parties' environmental and commercial interest. Our panel with Mary Walker, Peter Petrov, and Juliana Ghasemipour-Yazdi, led by our moderator Sascha Ferz, will discuss the approaches, options, alternatives and chances #mediation offers to resolving #environmental disputes. What a great looking series for First Nations leadership and staff! Understanding the (colonial) impact assessment world can be difficult, to put it mildly. "The imposition of Crown sovereignty and the displacement of First Nations from their lands and waters have limited many First Nations’ capacity to uphold stewardship responsibilities." This directly impacts #FPIC: one can not provide consent if there is not a fulsome understanding of the process and impacts a project has on a community. #ImpactAssessment #LandUse #UNDRIP

The Hon. James Allsop AC will deliver an evening talk at 6.30pm on Wednesday 19th June for the Ciarb (East Asia Branch). Taking place in Hong Kong, the talk, titled ‘Climate Change, Policy and Arbitrability’ will focus on legal liability in sovereign courts for emissions of carbon and related greenhouse gas (GHG) emissions. One issue of some importance in those cases has been the justiciability in courts of complex government policy for GHG emission control. The question arises as to how responsibility for GHG emissions will filter down into arbitrations. In that context questions of arbitrability may arise as questions of justiciability arise in sovereign courts. This and the nature of the claims for legal responsibility will be discussed.
