The UK government has approved a proposal to have judges from countries served by the Privy Council sit on appeals to the judicial committee.
📈 As Lord Reed, president of the UK Supreme Court and the judicial committee of the Privy Council, notes:
"Having the benefit of the opinion of a judge with direct experience of local conditions can only enhance the quality of the Privy Council's decision-making."
📖 The most important legal issues have, for centuries, been determined solely by people in London who had little practical knowledge of, and had often never even visited, the societies for which they were making the most momentous decisions.
👩🏽⚖️ For countries served by the Privy Council, this development preserves the benefit of having their most difficult legal issues considered by some of the most experienced judges in the common law world, while making the process considerably less anachronistic.
We have little doubt that the news will be welcomed in the jurisdictions that retain the right of appeal to the Privy Council, in which Dentons practises, including #BVI, #Cayman, #Anguilla, #Antigua, #Grenada, #Jamaica, #Mauritius, #Montserrat, #Nevis, #StKitts, #StVincent and #Trinidad.
