Last chance to register for this upcoming ITA Americas Intiative program, "𝐈𝐓𝐀 𝐀𝐦𝐞𝐫𝐢𝐜𝐚𝐬 𝐈𝐧𝐢𝐭𝐢𝐚𝐭𝐢𝐯𝐞 𝐞𝐧 𝐀𝐬𝐮𝐧𝐜𝐢ó𝐧: 𝐄𝐥 𝐚𝐫𝐛𝐢𝐭𝐫𝐚𝐣𝐞 𝐲 𝐞𝐥 𝐄𝐬𝐭𝐚𝐝𝐨". This program will be held tomorrow May 24th, hosted by CEDEP, and with the support of the Centro de Arbitraje y Mediación Paraguay and the Cámara Nacional de Comercio y Servicios de Paraguay - CNCSP. Arbitration in Paraguay has been consolidating over recent years. In fact, Paraguay has an enviable regulatory framework when it comes to arbitration. With regard to the public sector, this consolidation occurred after the promulgation of three relatively new laws, which included express authorizations for arbitration in public procurement: Law No. 1879/2002 “On Arbitration and Mediation”, Law No. 1618/2000 “On Concession of Public Works and Services” and Law No. 2051/2003, the latter being recently replaced by Law No. 7021/2022 “On Public Supply and Contracting”. That is to say, not much more than 20 years have passed since arbitration was expressly authorized in our country for contracts with the State. In this relatively short time, a series of questions have already been raised in arbitration practice linked to the State. Excellent article in El Confidencial about Ramco Litigation Funding roundtable last week in the Open de Arbitraje, with our CEO, Cristina Soler, Jose Julio Figueroa (ACCIONA), Carlos Gutiérrez García (Siemens Gamesa) and Ignacio del Cuvillo (Repsol) and moderated by Claudia Frutos-Peterson (Curtis, Mallet-Prevost, Colt & Mosle LLP) about trends in investment arbitration and application to Third Party Funding. The companies expressed concern about the duration and costs of investment arbitration and the need of more transparency. In this context, Third Party Funding is a solution to help claimants expedite the enforcement of arbitration awards and share risks. The use of Third Party Funding has become more widespread in the commercial and investment arbitration arena in the last 5 years. According to the annual survey of the Global Arbitration Review (GAR) 100 survey, law firms reported 208 funded arbitrations in 2023 compared to an average of 196 arbitrations per year between 2019 and 2022.
