Do arbitrators have a role in encouraging parties to settle a dispute? Since the 2021 ICC Arbitration Rules, arbitrators are empowered to “encourage the parties to consider settlement.” But this raises many questions - What is the appropriate moment for an arbitrator to raise the issue of settlement? How to ensure the parties maintain their trust in the arbitrator's neutrality? On 1 June 2024, the 2024 Administered Arbitration Rules of the Hong Kong International Arbitration Centre will come into effect. The 2024 Rules maintain HKIAC’s “light touch” approach to case administration, which respects party autonomy and has been a fundamental feature of HKIAC administered arbitrations. This means that parties who have adopted arbitration under the HKIAC Administered Arbitration Rules in force when the arbitration commences can rest assured that the regime they have adopted continues to apply with no unforeseen drastic changes, while benefitting from enhancements and improvements. The key changes seek to enhance time and cost efficiency of arbitrations, protect their integrity, and promote diversity and greener arbitrations. Many of the changes incorporate HKIAC’s existing practices into the rules. Our latest article is out! This article explores one of the notable provisions of the Nigerian Arbitration and Mediation Act 2023 (the 'Act') - the ability of arbitral tribunals and arbitral institutions to place a lien on arbitral awards when parties fail to pay their fees and expenses, until such amounts are fully paid. Outside that, the article explores other mechanisms available to arbitrators for securing their fees and expenses, comparing the provisions of the Act with the rules of prominent international arbitration institutions, such as the International Chamber of Commerce (ICC) and the London Court of International Arbitration (LCIA). 📈 ICC's 2023 Preliminary Arbitration Caseload Reveals Growth! 📁 The ICC's preliminary caseload for 2023 shows a notable increase to 890 arbitration cases, up from 710 in 2022. The total amount in dispute for all new cases in 2023 was USD 53 billion, with France, the UK, Switzerland, the US, and Brazil as leading arbitration seats. 🌐 Parties from 141 jurisdictions were involved, with significant growth in cases from Central and Eastern Europe, North America, and the Middle East. ⏳ Additionally, a record 189 cases were administered under the Expedited Procedure Provisions. The ICC Arbitration will release a full report on its caseload statistics later in the year. #ICCArbitration #CaseloadStatistics #Arbitration

13th Annual Commercial Arbitration Symposium 2023 (29 November 2023, 11.30am - 6.00pm (GMT +8)) SIArb invites you to join us for our 2023 Annual Commercial Arbitration Symposium that is held in a distinctive and interactive forum for participants to discuss current issues and developments in the field of commercial arbitration. Always popular, the Symposium features no set speakers or speeches. The success of the Symposium is based on the free-flowing discussion of current issues, suggested by delegates. Delegates whose topics are chosen will be invited to introduce their questions or topics, which will then be followed by an open discussion under the moderation of the experienced co-chairs from Singapore and abroad. Each delegate is therefore invited to contribute upon registering at least 2 questions or topics for discussion. There is no limit to the number of topics that each delegate may contribute, and additional questions may be emailed to secretariat@siarb.org.sg. The topics will be grouped into themes and allocated to one of the three working sessions, but the titles of the sessions are not prescriptive; participants are encouraged to present questions on any matter relevant to the practice of commercial arbitration. We return again to the Old Parliament House, with the working sessions of the Symposium held in the atmospheric surroundings of the former parliamentary debating chamber.
