One inventor’s Arsenal 🏹 of 50+ SEPs is taking on giants 🏹 Genghiscomm Holdings LLC owns more than 50 US granted Standard Essential Patents (SEPs) relating to 4G and 5G🗼 technologies . Interestingly only one person is named as inventor of these patents and they are not declared at any Standard Setting Organization (SSO). 🏹 Recently Samsung was hit with the patent infringement lawsuit after failed conversations for more than 3 years with the plaintiff (Genghiscomm). 🏹 The other giants sued for similar patents (separate cases) are: #️⃣ LG Electronics Inc #️⃣ Oneplus Technology Shenzhen Co Ltd, #️⃣ TCL Communication Ltd, Asustek Computer Inc #️⃣ Continental Automotive Systems US Inc and #️⃣ Toyota. 🏹The asserted patents 📄don’t appear to be declared at standard‐setting organization (SSO) databases of 3GPP/ETSI. 🏹Will there be any implications on FRAND Fog? Only two #FRAND determinations by courts worked out really well for SEP holders: Ericsson v. HTC (E.D. Tex., aff. by 5th Cir. in 2021) and Unwired Planet, Inc. v. Huawei (EWHC, aff. by EWCA & UKSC with focus on jurisdiction for global rates). By coincidence, the second case was also about (former) Ericsson #patents. For SEP holders, other FRAND determinations by courts range from disastrous (e.g. Microsoft (implementer) v. Motorola Mobility (W.D. Wash.) and Optis Wireless v. Apple (UK, appeal to be decided next year)) to disappointing (e.g. Nokia v. OPPO (China), InterDigital, Inc. v. Lenovo (UK)). The leading FRAND rate-setting jurisdiction is not the UK, but China, where the courts are now, subject to case-specific considerations, allowed to make such determinations even for entire #patent pools. One of the most interesting legal questions surrounding the Unified Patent Court is going to be if, and (if so) in which circumstances, it will engage in FRAND rate-setting.
