Sharing this commentary from Japanese PM Taro Kono emphasizing the importance of keeping government intervention in business deals fair and principled. While national security and labor issues can sometimes influence the free market, Kono raised concerns that politics, particularly in light of the U.S. presidential election, may be distorting the process. M&A and foreign policy don’t mix! Given the close relationship between the United States and Japan, it is crucial to keep politics out of the regulatory process. Although election year politics may make it tempting for some in Washington to use this as a campaign issue, it is not in the best interest of the US in the long run. By keeping politics out of the regulatory process, we can ensure fair and equitable treatment of businesses and maintain a healthy trade relationship with Japan. #mergersandacquisitions #Japan #trade #antitrust

Business getting hijacked by politicians...welcome to election year M&A. Great job by Liz Hoffman in spotlighting what is already a hot topic in the upcoming election(s). "Some of the year’s biggest mergers are being tripped up by politicians preening for voters and riding a broader wave of economic protectionism that has accelerated since the pandemic." Even here in our little corner of the world that is the Tokyo legal recruitment market, election year is influencing hiring decisions and strategy. With Japan sandwiched between the US and China, particularly in a business context, there's no escaping the influence of overseas politics. And not just in the US; "half of the world’s population will vote in a national election this year". May we all get through this year's elections safely, smoothly, and with minimal preening and grandstanding (fat chance that may be!). Finally, I take it that the voice of disagreement has never heard of LTCB when he proclaims that Japan would take a different approach: “I find it very hard to believe that Japan would let a US firm swoop in and purchase a historic, legacy company in such a critical industry." https://lnkd.in/dAK9JTfd

Germany will abstain during Friday's EU Council vote on the CSDDD, Federal minister for Labor and Social Affairs Hubertus Heil has now confirmed. Heil had to give in to demands from the co-ruling liberal party. "While Germany alone cannot block the law's approval, its abstention would be seen as a substantial sign of disapproval which other countries unhappy with the law could follow." Other countries that have voiced concerns related to the CSDDD include Sweden, Estonia, Lithuania, and the Czech Republic (https://lnkd.in/d2CNdhWs). Oddest thing: German business associations and companies pushed for the CSDDD to level the playing field within Europe (as Germany already had a supply chain law). The CSDDD took over 3 years to negotiate and reflects a carefully balanced compromise between 27 member states and the EU parliament. Failure is not an option... #csddd

Pleased to speak to Rintaro Tobita of Nikkei and Nikkei Asia on the Nippon Steel Corporation-U.S. Steel deal deal now that it's in CFIUS review and the general presidential campaign is kicking off. Neither Trump or Biden have explicitly said anything that would categorically sink the deal, as their emphasis have been on protecting American jobs and union workers. We'll see how that changes in the next 9 months, but each candidate has wiggle room on this issue. #steel #2024election #japan

The political and economic implications of Nippon Steel's bid to acquire US Steel, focusing on President Biden's opposition to the deal as part of his strategy to protect domestic industry. This move has potential repercussions for US-Japan relations and could influence the upcoming elections. Negotiations involving the United Steelworkers union add another layer of complexity to the situation. The decision remains highly sensitive and politically charged. 1moIf we want free markets then they need to be free! I agree, too bad our government doesn’t understand this fact! If it was a Chinese company it would be a different story.
