A relation subsisting between two persons in regard to a business, contract, or piece of property, or in regard to the general business or estate of one of them, of such a character that each must repose trust and confidence in the other and must exercise a corresponding degree of fairness and good faith. The orange oligarch faced yet another contempt of court hearing yesterday, in part for attacking the jury on #socialmedia. The potential dangers of the former presidents' disrespect for the #ruleoflaw were starkly illustrated by an interview with a potential juror who was not even called upon to serve. In an interview with The Independent a man who was excused from Donald Trump’s criminal trial revealed he had received death threats, despite not even being called to serve on the jury in the trial -  https://lnkd.in/ebMHDB6V This sort of threat by a troll was all too predictable, and was plainly designed to interfere with the course of #justice. The fact it happened demonstrates the need for juror anonymity in the ongoing trial, and the importance of the press respecting it rather than engaging in speculation (and reporting) on those personal details that they become aware of. Another juror was excused after being sworn, she was identified as a result of personal details being published and she was simply too stressed to continue. As we speak no doubt numerous keyboard warriors and assorted loons are researching the identities of the 12 who were actually selected (and the alternates) to serve as jurors in the first criminal trial of the hero of the #maga universe. In England and Wales this sort of conduct might well lead to a trial by a #judge sitting without a jury, even if the case had already begun with one. The relevant provisions are in the Criminal Justice Act 2003 sections 44 to 46, if the trial of #donaldtrump was taking place in England his counsel would be aware of this citation; "it should be clearly understood, however, that, if an attempt is made during a trial to tamper with the jury to the extent that the judge feels it necessary to discharge the entire jury under s.46, below, the judge may continue with the trial and deliver a verdict without them." J, S and M [2010] EWCA Crim 1755; [2011] 1 Cr. App. R. 5. I have no idea if there is a similar provision in the #usa and in #newyork in particular. US #attorneys will know. You have the right to a fair trial, you have a right to free speech, but rights are tempered with responsibilities and you do not have the right to intimidate anybody involved in court proceedings. Trial watchers might also think it was very interesting to note the shift from professing an intention to give evidence and its replacement with the (entirely false) suggestion that the "gag order" prevents the defendant giving evidence and makes the trial unfair. Perhaps the businessman turned presidential candidate thought his previous possession of the "bully pulpit" gives him carte blanche to say what he likes, when he likes, but it does not permit even former presidents to bully anyone and everyone it suits nor does it excuse contempt of court. #criminaljustice #law #criminallaw #legalprofession #legaleducation

"For the people" is most famously attributed to a former American President - an attorney who was actually principled, inspiring, and genuinely "for the people" -- perhaps you've heard of him: his name is Abraham Lincoln. He included "for the people" in the Gettysburg Address. You may have attached "for the people" to your firm, but you don't own it, and you don't live by it.
