The US Federal Trade Commission (FTC) has voted to ban most noncompete agreements for the US workforce, freeing up an estimated 30 million American workers from these agreements and allowing them to change jobs within their industry or start their own businesses. However, the new rule does not apply to senior executives who earn $151,164 or more per year and those in policymaking positions. The legal tech industry has a range of opinions on the impact this ruling will have on hiring and talent acquisition, with some experts viewing it as a boost to innovation and legal tech careers. Some believe that a lack of noncompete agreements would encourage more startups and spur innovation, while others feel that companies invest significant time and resources into training employees and are not keen on seeing them get poached by competitors.
🔏 From "weaponizing" noncompetes as "bullying tactics" to throttling innovation, legal tech experts cited a handful of examples of how the FTC ban could stand to change the sector. Indeed, about 30 million U.S. workers will be unshackled from their noncompete clauses if the FTC's rule survives legal battles. State Bar of California recently emailed all active attorneys with the news that the legislature has authorized a few changes to our licensing fees – including fee amount and deadline. Importantly, there are some pieces that impact legal aid attorneys: 1) Attorneys who work at IOLTA-funded nonprofits are still eligible for licensing fees scaling. Employers are able to pay their attorneys' fees through the Agency Billing portal. 2) BIG NEWS! MCLE reporting period has changed! Are you in MCLE Compliance Group 1? If your last name begins with A-G, your three-year compliance deadline is now March 30, 2025. Thanks to Bryan Koenig at Law360 for quoting me in his latest article! Bottom line: there's no reason for employers to panic or act hastily in response to the decision out of Pennsylvania concerning the FTC's noncompete ban, as the Texas court plans to issue a final merits ruling by August 30 and even if that court does not vacate the rule, to the risks associated with untimely compliance (or even noncompliance, depending on the ruling) are quite low in my opinion.
