A welcome ruling from the Dubai Court of Cassation reaffirming the requirements to enforcement of foreign judgments in the UAE. The Court confirmed that the law does not allow the issuance of an order to enforce a judgment issued by a foreign court when UAE courts are exclusively competent to consider the dispute. Therefore, the fact that there is "shared jurisdiction" between the UAE courts and the foreign court, meaning that each of them is competent to consider that dispute, does not in itself prevent the issuance of an order to enforce that foreign judgment. https://lnkd.in/dVta4aJm https://lnkd.in/dr9me5f7

This means showing a direct and tangible connection to the subject of the dispute. 2. Direct Injury or Harm: • Typically, the party initiating legal action must have suffered or is likely to suffer direct injury, harm, or prejudice as a result of the actions or decisions being challenged. Courts require a direct link between the legal dispute and the party bringing the case. 3. Statutory Requirements: • Specific laws and regulations in the UAE may outline the criteria for standing in certain types of cases. For instance, in administrative or environmental matters, the relevant laws may prescribe the conditions under which an individual or organization can bring a case. 4. Public Interest Standing: • In some cases, individuals or entities may be granted standing based on the broader public interest involved. This is less common and often subject to specific legal provisions allowing for such representation. 5. #Dubai Court of Cassation confirms foreign (Poland) judgment can be enforced in the #UAE. The Court confirmed that although UAE courts had jurisdiction to determine the underlying dispute (which had been a basis to deny enforcement in the past), such jurisdiction was not exclusive, and the foreign court also had jurisdiction. As such, the UAE courts have the power to enforce the judgment under Article 222 of the new Civil Procedure Law 2022. This is a positive and useful decision for parties seeking to enforce foreign judgments in the UAE. More details below in this article from K&L Gates:

This decision from Dubai Courts is a game changer! The Dubai Courts recognized and enforced a summary judgment from the English High Court of Justice within one business day. Just one day. 𝗟𝗮𝗻𝗱𝗺𝗮𝗿𝗸 𝗗𝘂𝗯𝗮𝗶 𝗖𝗼𝘂𝗿𝘁 𝗗𝗲𝗰𝗶𝘀𝗶𝗼𝗻𝘀 𝗦𝗶𝗴𝗻𝗮𝗹 𝗣𝗿𝗼-𝗘𝗻𝗳𝗼𝗿𝗰𝗲𝗺𝗲𝗻𝘁 𝗦𝘁𝗮𝗻𝗰𝗲 𝗳𝗼𝗿 𝗙𝗼𝗿𝗲𝗶𝗴𝗻 𝗝𝘂𝗱𝗴𝗺𝗲𝗻𝘁𝘀 Listen. This judgment came via an interlocutory application, not a full trial. The Dubai Court of Cassation confirmed the enforcement of an English Court judgment, establishing reciprocity. English and UAE Courts now recognize each other’s judgments. This landmark decision follows a series of influential rulings and circulars. For instance, the 2021 English Court of Appeal decision and the 2022 UAE Ministry of Justice circular. Together, they reinforced the principle of reciprocity in enforcement, paving the way for such milestones. Further, the Dubai Court of Cassation accepted the enforcement of a Canadian summary judgment. The court distinguished between interim orders and summary judgments.
