For me, if it is against the contract from the employer, why the employer will tolerate it? The purpose of a contract is to be followed by both parties as an obligations & responsibility, and employee must be aware of it upon signing especially on what's the term inside of it! It's a matter of being a responsible employee for not being a responsible one, period!
