These days, The IAC Eurasia Arbitration Week 2024 is taking place in the AIFC. Yesterday, one of the topics of discussion was the ethical behavior of representatives of the parties and arbitrators.   Taking into account different ethical standards (at the seat of arbitration, at the location of the arbitral institution, at the place of residence of the party, at the place of residence of the representative of the party, at the place of residence of the arbitrators), it was proposed to develop a universal code of ethical conduct that would contain the basic principles of ethical conduct in international arbitration.   Obviously, ethical behavior is relevant not only in arbitration but also in court proceedings. Thus, the duty of legal representatives to tell the truth is recognized as a universal and generally accepted duty for all countries and jurisdictions.   The Civil Procedure Code of Kazakhstan contains the obligation of the parties to the dispute, and therefore their representatives, to declare to the court the actual circumstances of the case completely and truthfully (Article 46.2).   The obligation to give truthful testimony also applies to witnesses (Article 81.1).   Meanwhile, criminal liability for knowingly giving false testimony is imposed only on witnesses (Article 81.3). Whereas the failure of the parties to the dispute and their representatives to fulfill their obligations, including telling the truth only entails procedural consequences, not criminal liability (Article 46.2).   The lack of real responsibility for lying in court is the reason for the widespread use in court of deliberate false testimony of the parties to the dispute and their representatives. The court is thereby misled regarding the circumstances of the case and the evidence.   There is a total distrust of what was said in court. This increases the costs of judicial proceedings, deprives the parties to the dispute of certainty, and makes faithful participation in the proceedings disadvantageous.   In this regard, I consider it necessary to introduce criminal liability in Kazakhstan for the parties to the dispute and their representatives for violating their obligation to present truthful statements. This will increase the efficiency of dispute resolution in court and ensure compliance with international liability standards for violation of ethical standards of behavior.
