To the extent that pop star Ed Sheeran’s hit song “Thinking Out Loud” borrowed from the chord progression and syncopated harmonic rhythm of the Marvin Gaye classic “Let’s Get It On” (written by Gaye and Ed Townsend), Sheeran did not engage in #copyright infringement because those elements were merely “fundamental musical building blocks” that were not protected by copyright, according to the U.S. Court of Appeals for the Second Circuit. The appellate court affirmed a New York federal district court’s grant of summary judgment in Sheeran’s favor in a lawsuit brought by a company that owns a one-ninth interest in the royalties from “Let’s Get It On” (one-third of Townsend’s one-third share). In the Second Circuit’s view, the infringement claims, which depended on the combination of a four-chord progression and a syncopated harmonic rhythm, failed as a matter of law. “Courts have been consistent in holding that the basic chord progressions so ubiquitous in popular music are unoriginal and, thus, unprotectable,” the Second Circuit said. The harmonic rhythm was deemed similarly unprotectable. The court also concluded that there was nothing particularly unique about the combination of the asserted song elements. Iris Toepoel and Etienne Valk of Instituut voor Informatierecht (IViR) wrote a blog about the #copyright issues on parts of Anne Frank’s diary, which expired in some countries.
