The contexts in which international institutions support environmental and development interventions are increasingly characterized by fragility, conflict, and violence (FCV). Insecurities are exacerbated by #climatechange and natural resource degradation, placing greater strain on economic, social, and political systems already under pressure. The challenges facing implementation and evaluation of environmental programs were the focus of the FCV session at this year’s Conference on Evaluating Environment and Development. Beware the anthropogenic mush. The first full day of the ABA SEER 53rd Spring Conference on Environmental Law in Chicago featured a superb presentation by Bonnie Barnett, Greg Christianson, and Seth Kellogg, PG that attempted to anticipate, through the use of historical analogy, what might happen if PFAS chemicals (specifically PFOA and PFOS, the human-made synthetics compounds used in firefighting foam, cookware, fast food packaging, and myriad other commercial products) were classified by the US Environmental Protection Agency (EPA) as hazardous substances under CERCLA. Some takeaways from the discussion. For contaminated sites in various stages of closure, and even those where the remedy had been finalized, everyone should expect a significant increase in costs. Make sure you know the ambient PFAS levels at your site—this anthropogenic mush (their words but love it) represents the societal or shared impact of this ubiquitous chemical compound over time. Gain intellectual control over the chemical inputs of your supply chain—intentional, unintentional, current, and historical. There are more than 10,000 compounds in the PFAS chemical family tree and the list is rapidly expanding. Finally, watch cleanup efforts at United States Department of Defense sites.
