Navigating trustee issues in sectional title communities. Buying a property is daunting. More so is purchasing a unit in a complex that falls under the Sectional Title Act, as there are strict laws that govern their day-to-day running. It is important to note that owners do have recourse against Trustees that abuse their power and such recourse includes voting to have them removed, formerly expressing their concerns in writing to the trustees to have a record of grievances, issue binding directives during a meeting that limits their powers, as well as calling an urgent SGM to address certain matters. From natural disasters to government changes, these developments are reshaping the way we work and highlighting the protections in place for employees worldwide. Recent world events, from natural disasters to political shifts, are having a big impact on employment laws globally. In Brazil, labour laws have been suspended due to severe flooding, while the United Kingdom and Mexico are considering employment law reforms following changes in government. Protections around dismissal vary widely, with new rules in Belgium for employees undergoing infertility treatments and no compensation for certain dismissals in Peru. As AI and digital platforms grow, countries are still working to address these challenges. For South Africa, these developments highlight the need to continuously assess local labour laws, especially in areas like protection from harassment, workers' rights, and the impact of technology. Staying ahead of these changes will ensure that businesses remain compliant and protect their employees in a shifting global landscape. Thistle Trust faced capital gains tax after a sale of assets in 2014-2016. Following legal advice, the Trust did not report these gains, believing that the ultimate beneficiaries were taxable. SARS audited and held Thistle Trust liable, but the Tax Court ruled in favour of the Trust. The Supreme Court of Appeal upheld SARS' appeal, stating that the conduit principle applies only in specific circumstances. Thistle Trust sought leave to appeal in the Constitutional Court, while SARS filed a conditional application in respect of understatement penalties. Artificial intelligence is transforming recruitment by offering speed and efficiency, but what happens when it unintentionally perpetuates bias? A recent US court case, Mobley v Workday Inc., sheds light on this issue. The case highlights how Workday’s AI-based recruitment platform allegedly excluded Black, older, and disabled applicants. This ultimately raised significant concerns about fairness in AI-driven hiring. It appears that even neutral-seeming AI platforms can replicate societal biases, especially if trained on skewed data. It is a global issue with local relevance, particularly in South Africa. South Africa’s Employment Equity Act requires that recruitment processes are free from unfair discrimination based on race, gender, age, disability, and other protected grounds. As we move towards the formal regulation of AI with South Africa's National AI Policy Framework, employers need to stay vigilant. Companies using AI for recruitment must ensure strong oversight, regularly audit AI outputs for bias, and align with local employment laws like the EEA. The future of recruitment is here, but we must ensure it is fair, inclusive, and ethical.
