NEWSFLASH | A recent decision by the Labour Appeal Court (LAC) in Algoa Bus Company (Pty) Ltd v Tirisano Transport and Services Workers Union (TASWU) obo Mzawi and Others considers an employer’s onus in proving the fairness of a dismissal for misconduct, particularly when it comes to the appropriateness of #dismissal as a sanction. NEWSFLASH I Kuwait has ratified the protocol to its #DoubleTaxAgreement (DTA) with South Africa. The Kuwaiti DTA currently provides for a #DividendsTax rate of 0% for Kuwaiti Qualifying Shareholders. This also applies to Swedish and Dutch Qualifying Shareholders because of the Most Favoured Nation clauses in their DTAs with South Africa. Once effective, the protocol will mean that Kuwaiti, Swedish and Dutch Qualifying Shareholders will no longer enjoy a zero dividends tax rate. What’s more, the protocol stipulates that its provisions will have effect from the date that dividends #tax came into effect in South Africa, namely 1 April 2012. Partner, Esther Geldenhuys, and senior consultant, Aneria Bouwer, say that this is hugely problematic for South African companies which have relied on the Kuwaiti, Swedish or Dutch DTAs since 1 April 2012 to not withhold dividends tax from dividends declared to Qualifying Shareholders.
