    Transforming Child Justice in Australia: "A Call for Early Intervention and Comprehensive Reform" A recent report, "Help Way Earlier! How Australia Can Transform Child Justice to Improve Safety and Wellbeing," calls for urgent reforms to the child justice system in Australia, highlighting that the current approach, which often criminalizes children as young as 10, fails to address the root causes of offending behavior. Children and young people involved in the report emphasize that crime is often a symptom of unmet needs, rooted in social disadvantage. Instead of focusing on punitive measures like policing, strict bail laws, and incarceration, the report advocates for a shift towards policies centered on child wellbeing and human rights. Key recommendations include establishing a National Taskforce for child justice reform, appointing a Cabinet Minister for Children, creating a Ministerial Council for Child well-being, and enacting a National Children’s Act along with a Human Rights Act. The report underscores the importance of placing children at the heart of policymaking, empowering First Nations communities, supporting community-based initiatives, and building a child-specialized workforce. As of August 26th, 2024, several key changes have come into effect that directly impact employers across various sectors, this is part of closing the loopholes. Below is just a reminder about these updates - crucial for ensuring compliance and maintaining a fair and supportive workplace environment. A reminder and what you need to know: Casual employment changes - Rules about casual employment have changed, including how casual work is defined, pathways to permanent employment, and employee and employer responsibilities. Right to disconnect - Employees have the right to refuse contact outside their working hours unless that refusal is unreasonable. Learn about the new right to disconnect. This doesn’t apply to small businesses and their employees until 26 August 2025. Independent contractor changes - If you’re a contractor or work with contractors (ABN holders), it’s important you understand the new definition of employment and other changes to independent contractor rules. Minimum standards and protections for some contractors - If you’re in the gig economy or know someone in the road transport industry, find out about new minimum standards and protections for some contractors.     Right to disconnect begins today The Fair Work Ombudsman reminds employers and employees that the new right to disconnect begins today for non-small businesses. The right to disconnect is a change to the Fair Work Act as part of the new Closing Loopholes laws. Employees of non-small businesses (a business employing 15 or more employees) now have the right to refuse to monitor, read, or respond to contact (or attempted contact) outside their working hours unless that refusal is unreasonable.
