It was my pleasure to attend a reception at the Supreme Court of Canada | Cour suprême du Canada yesterday evening recognizing the amazing work of the Supreme Court Advocacy Institute and hearing from some of its founders including the Honourable Frank Iacobucci, C.C., K.C., L.S.M. seen here speaking in the court for the first time since his retirement from the SCC 20 years ago. The Canadian Bar Association and the Ontario Bar Association Foundation are proud supporters of the institute which provides free, non-partisan advocacy advice to lawyers appearing in an appeal before the Supreme Court of Canada. The Supreme Court of Canada has found that the doctrine of corporate attribution can be applied in a bankruptcy and insolvency context, but it must be done so in a purposive way to ensure that fraudsters do not benefit over legitimate creditors.
