🇹🇷⚖️ Turkish perspective on arbitration: how Istanbul Arbitration Centre / ISTAC changed the arbitration landscape in Türkiye. In the margins of Istanbul Arbitration Days, Müge Bakırcıoğlu (Erdoğmuş), LL.M. interviewed Dr. Candan Yasan Tepetaş – the Founding Secretary General of ISTAC, who stood at the forefront of transforming the approach to international arbitration in Türkiye. Today, she is an Assistant Professor at Istanbul Bilgi University, a member of ICC Arbitration and ADR Commission, and a seasoned arbitration practitioner. 🧐 What happens when Civil Law meets Common Law in arbitration? 📌 When lawyers come from different legal traditions, challenges may arise. Those from Common Law jurisdictions, such as the USA or England & Wales, and Civil Law jurisdictions, such as Germany or France, sometimes have divergent expectations: 📝 What should the role of a judge, an arbitrator, or an expert be? 👩⚖️ To what extent should judges and arbitrators guide the parties? 🔎 How should witnesses be examined, and is it permissible to prepare them? 📄 Can contracts be interpreted against their clear wording? 📚 Should parties be compelled to produce documents which are not in their favour? These are not just theoretical questions for us at BODENHEIMER. Ensuring coherence and that nothing gets "lost in translation" is a crucial part of our daily practice. And we are glad to have had Tobias A.
