It was truly an honour to be invited by our good friends Bastiaan Kemp and Olivier van der Haegen (Loyens & Loeff) to participate in a round table discussion on document disclosure this past Wednesday, with the great Alexander Blumrosen (Polaris Law ). A few takeaways: 1- Bastiaan Kemp is very serious about timekeeping and, most importantly, both him and Olivier van der Haegen do not shy away from asking the difficult questions (rightfully so). 2- Document production schedules can be horitonzal, vertical, pre-filled, colour-coded or non-existent. There is no one way of doing it or of getting it right ! 3- Alexander Blumrosen knows everything there is to know about The Hague Convention on the Taking of Evidence. 4- The Prague Rules are seldomly applied in practice. Adverse inferences rarely granted. 5- Proactive case management is key to ensuring a smooth disclosure process. Just when you think that a subject has been over done, get a diverse group of arbitration practitioners in a room and get them talking. Disclosure of documents in IA may not be the sexiest topic, but we had such an interesting and insightful conversation around what works, what doesn’t, and how to appease the common law v civil law tensions that come clashing head-on whenever compelled disclosure is at play. What are the current trends in dispute resolution in Germany? According to Sven Lange courts are highly efficient, often resolving first-instance cases in less than a year. While many commercial disputes are handled in court, arbitration is often chosen for post-M&A and international disputes. The German Arbitration Institute (DIS) is popular for domestic cases. However, the SCC enjoys a robust reputation and is frequently selected for international disputes, showcasing a growing reliance on international arbitration institutions.
