The dispute is quite complex and comprises several different cases pending with the General Court that were all discussed in today‘s hearing. We are looking forward to the Court’s decisions!

We are excited to share that Grünecker has successfully represented RatPac Entertainment LLC in landmark legal proceedings across all instances in the EU and in Germany.   On the EU level, the EU General Court dismissed the claims brought by Rat Pack Filmproduktion GmbH and confirmed in favour of our client´s trademark application that there is no similarity between "film production" and "financing services".   In Germany, the Federal Court of Justice (BGH) dismissed Rat Pack Filmproduktion GmbH's complaint, concluding the legal dispute between the same parties that had been ongoing since 2015. The favorable decision of the Munich Court of Appeal (OLG) is therefore now final. Rat Pack Filmproduktion GmbH had unsuccessfully claimed trademark and company name infringement over the use of “Ratpac” in trailers, film credits, DVD covers, and movie posters - and further alleged that “film financing” would be similar to “film production” for the German audience.   Congratulations to Holger Gauss, Elvira Bertram and Natalie Vachova for their outstanding work and dedication over years of litigation!   Please click here for the full article: https://lnkd.in/gMdWHKqH
