The principle of transparency requires that any information and communication relating to the processing of personal data is easy to access easy to understand, and that clear and plain language is used. The Data Protection Commission is Ireland’s independent supervisory authority tasked with upholding individual data protection rights and regulating the data processing activities of the organisations operating within our jurisdiction. The DPC is the Irish supervisory authority responsible for monitoring the application of the General Data Protection Regulation (GDPR), and we also have functions and powers related to other regulatory frameworks, including the Irish ePrivacy Regulations (2011) and the EU Directive known as the Law Enforcement Directive (LED). If you're an organisation processing personal data, then first ask yourself, 'what is my reason or justification for processing this personal data?'. This is of key importance because any processing of personal data is only lawful where it has what is known as a 'legal basis'. Article 6 of the GDPR sets out what these potential legal bases are, namely: consent, contract, legal obligation, vital interests, public task, or legitimate interests.
