The Minister for Finance, Jack Chambers T.D., has today (Tuesday) published the Report of the Funds Sector 2030 - please see attached link for details. IFDA met with the Department in January 2024 to share our views as they pertain to governance and the role of INEDs in the funds industry. Irish Fund Directors Association (IFDA) members may be interested in the below post and attached legal briefing by Mark Browne from Clerkin Lynch LLP as regards MIFID firms: "The Central Bank of Ireland (the “CBI”) has issued a “Dear CEO” letter as a follow up to the recent Common Supervisory Action on the MiFID II Marketing Communications Requirements. This Letter includes specific actions which not only MiFID firms but also credit institutions and fund management companies providing MiFID II services must comply with by January 2025. In light of the ongoing responsibilities of Management Companies for distribution activities this will be highly relevant to the third party manco sector in particular. Will this result in more upward pressure on fees ?" The Central Bank of Ireland has announced new processes for certain filings. The changes relate to the clearance of investment managers and non-EU AIFMS as well as mergers or amalgamations of UCITS and AIFs. (Its all a long way from when I started in the funds industry and a key part of a trainees role was seeing how fast you could get to the CBI with all the paperwork before they closed for the evening !) The Central Bank of Ireland has today published its latest Markets Update, setting out some changes to funds post-authorisation processes, including notification of the closure of the SFDR Level 2 streamlined filing process in the coming weeks. Importantly, the CBI has also published details of a streamlined filing process for updates to fund names based on the requirements set out in the ESMA guidelines. IFDA are very sorry to hear of the sudden passing of member and friend Philip Dempsey over the weekend. Phil was a stalwart of the funds industry here in Ireland for many years. He is remembered with fondness by his many friends and colleagues who will all miss his infectious enthusiasm and positivity.
