Dear All, We are rather pleased to publish an explainer on the recent complaint filed by All India Consumer Products Distributors Federation (AICPDF) against quick commerce platforms at the Competition Commission of India (CCI). The complaint, among other things, alleges that various quick commerce companies such as Blinkit, Swiggy Instamart and Zepto are engaging in monopolistic practices such as predatory pricing and deep discounting to the detriment of small retailers in the Indian market. The antitrust authority has been moved in the backdrop of platforms registering continuous growth in the users without observing a parallel splurge in profits. Our Director Sumit Jain and Assistant Professor Nikita Shah (Dr.) write for moneycontrol.com. The authors write on the UK's Digital Markets, Competition and Consumer (DMCC) Act and suggest that there is unique jurisprudential value to the law. While it does identify 'conduct requirements' on the part of the Big Tech, it falls short of prohibiting them on an ex-ante basis. The law is either set to be the legend in the field of rulemaking by catering to the perception of digital competition law, or reflect the delusion in the UK government public policy through exhaustion of resources. In such a case, this may reflect the best or the worst of the two worlds. The piece could be accessed here: https://lnkd.in/d-iDPdY6 #DMCC #UK #exante #digitalmarkets #publicpolicy

In a strategic move, the Indonesian government has recently asked Google and Apple to block Chinese fast fashion e-commerce firm Temu in their application stores in the country. Some of the reasons given by the government include a focus on regulations in the booming e-commerce industry, protect the country's small and medium-sized businesses against cheap products and curtail 'unhealthy' business practices of Temu which may be anti-competitive in nature. The announcement comes in the backdrop of the Indonesian government directing China's ByteDance social media platform TikTok to close its e-commerce service in the country to protect local merchants and users' data. Our Directors Vikrant Singh and Siddharth Mishra recently wrote an article for News18 India underlining the geopolitical dimension of tech policy. They highlighted how partnership and collaboration in multilateral fora could further India's strategic advantage. The European Court of Justice (ECJ) has recently held that the European Commission cannot scrutinize mergers which are neither beyond the thresholds mentioned in the EU, nor on a country-specific basis. The interpretation given by the EC and GC in the Illumina-Grail case to the merger regulations risk upsetting the balance between various objectives pursued by it and impinge upon the guarantee of foreseeability and legal certainty for the undertakings concerned. The European Commission (EC) has initiated regulatory dialogue with Apple Inc. under Article 8(2) of the Digital Markets Act (DMA) for effective implementation of the law. The purpose of this dialogue is to highlight specific obligations which would need compliance as far as interoperability is concerned. The dialogue is organised under two headers, i.e. interoperability for iOS connectivity features and functionalities, and the process which has to be setup as far as requests made by developers and third parties sre concerned. The said proceedings have begun on the discretion of the EC where the Commission seeks to 'assist' the smartphone maker in compliance as a soft-law measure. Our Directors Sumit Jain and Siddharth Mishra recently wrote on the importance of such measures when it comes to implementation of the law: https://lnkd.in/gDvadRZU #regulatorydialogue #DMA #interoperatability #amnestyscheme #softlaw
