  • A landmark ruling has just reshaped the interpretation of exceptional circumstances under the UK Statutory Residency Test (SRT). The case has had its twists and turns: 🔹 First-Tier Tribunal (2022) – Ruled in favour of the taxpayer, allowing six disputed days under exceptional circumstances.
🔹 Upper Tribunal (2023) – Overturned the ruling, rejecting moral obligations as a valid reason, leaving the taxpayer liable to millions in tax.
🔹 Court of Appeal (2024) – Reinstated the original decision, confirming that compelling moral obligations can qualify as exceptional circumstances. This decision has major implications for HNWIs navigating UK tax residency rules. It also highlights how these cases can drag on and lead to mounting legal costs and plenty of stress. We at Daysium are committed to helping people avoid these circumstances. To strengthen their day counting and record-keeping practices, enabling them to have evidence at their finger tips and the confidence to state: “There’s nothing to see here, everything is in order”. • 33% of individuals believe they’re highly unlikely to ever face a tax investigation. But more concerningly, 33% of respondents in our assessment have never even considered the financial or legal impact of an investigation. The reality is that: 💸 Tax investigations can cost tens of thousands in legal fees, advisor costs, and potential penalties, even if no wrongdoing is found. ⏱️ They’re time-consuming, often requiring years of detailed travel and financial records. 🧠 And the emotional stress of prolonged scrutiny? It’s immeasurable. Why does this matter for tax advisors? Your clients may be underestimating their exposure, leaving them unprepared both financially and emotionally. Your advisory expertise is invaluable and can help clients: ✅ Understand their actual risk. ✅ Proactively prepare documentation to withstand scrutiny. ✅ Mitigate an investigation's financial and emotional toll before it even starts. Want to help your clients assess their real risk? Share our Tax Residence Risk Score Assessment with them — or take the test yourself! This simple first step can help uncover gaps and strengthen compliance for any globally mobile individual. Find the link in our profile or visit our website.

  • 👀 Want to provide more value as a tax advisor for your clients? Tax residency rules are ever-evolving, and events like the end of the UK's non-dom regime highlight the importance of tax residency compliance. The problem is that traditional methods of counting days are prone to errors, and it can be difficult to get your clients to follow them meticulously. Daysium is a tax compliance platform designed to transform your clients' day counting and record-keeping. We automate the process and streamline the gathering of corroborative evidence. And now, we're opening our platform for more tax specialists worldwide. • 75% of individuals don’t stay actively informed about changes in tax laws in countries where they might be considered tax residents. And the 25% who do rely solely on media and online sources.
