    SPEAKING ENGAGEMENT: Our partner Irene Kashindi, FCIArb is attending as a panelist in the ongoing Second Employment and Labour Relations Annual Symposium and Exhibition (ELRASE II). Irene is part of a panel that will present on ‘Understanding the scope of convention 190, Recommendation number 206 and the extent they are provided for in the Kenya Constitution, Statutes and Policies’ About ELRASE II: Kenya has not ratified C190 – Violence and Harassment Convention 2019 (No. 190). The Ministry of Labour and Social Protection has recently invited public participation towards ratification of the Convention. However, provisions of the Constitution, statutes and policies exist in Kenya towards realization of C190 and the related ILO recommendation number 206 and the accompanying resolution. ELRASE-2 recognises the centrality of eliminating violence and harassment in the world of work. It offers a timely platform for stakeholders to better understand and apply the provisions of C190; to examine the domestic provisions in that regards together with the local and comparative jurisprudence; and, to examine sector-based experiences, manifestations and mainstreaming of the provisions.     Kashindis' Digest of Employment Cases | We continue to give snapshots and sample glimpses of cases covered under the over 40 thematic and sub-thematic areas in Volumes 1 and 2 of the Digest. Today, we explore whether an employee whose wages are paid weekly qualifies as a casual employee. This was addressed in the case of Harrison Meshack Lusimbo & another v Mareba Enterprises Limited (2013) eKLR, which appears at number 15 of Volume 1. The Claimant received his wages weekly. The court held that the Claimant was thus not a casual employee within the definition given under section 2 of the Employment Act. The Claimant had converted to a regular employee under section 37 of the Employment Act. The Court held that: "Section 37 of the Employment Act provides for conversion of a casual employee to a monthly contract of employment after working continuously for 1 month or intermittently for 3 months. The claimant therefore qualifies to be a monthly employee. By virtue of Section 37 [3] he is “entitled to such terms and conditions of service as he would have been entitled to under this Act had he not initially been employed as a casual employee”.
