Рады сообщить, что советнику 𝗔𝗘𝗤𝗨𝗜𝗧𝗔𝗦 Зухрие Дургаловой (https://lnkd.in/e5sWTHqj) удалось успешно защитить интересы клиента в сложном судебном процессе на всех этапах судебного разбирательства. В октябре 2024 года было вынесено финальное Постановление Верховного суда РК, согласно которому он поддержал предыдущие судебные акты, отказав в удовлетворении кассационной жалобы истца и оставил без изменений решения местных судов. В рамках данного проекта Зухрия Дургалова представляла интересы клиента в деле против другой казахстанской компании, которая пыталась оспорить постановления акима Меркенского района от 2007 года о передаче 230 га земли клиенту. Истец утверждал, что узнал о данных постановлениях только в 2023 году после проверки прокуратуры и просил #суд восстановить пропущенный срок для подачи иска. Уникальность и сложность данного судебного спора заключается в большом временном разрыве — постановления акима были приняты более 15 лет назад, и истец пытался доказать, что у него были уважительные причины для пропуска срока подачи иска. Зухрия Дургалова тщательно изучила все материалы, выявила и предоставила суду неопровержимые доказательства того, что истец был осведомлен о факте передачи земель до 2023 года, и аргументированно заявила о применении срока исковой давности, что сыграло решающую роль. Заслуга Зухрии Вановны заключалась в детальном подходе к сбору доказательств, глубоком понимании законодательства о сроках исковой давности, а также в эффективной работе по защите интересов клиента на протяжении всего судебного процесса. #law #DR #disputeresolution #aequitas

📣 𝗔𝗘𝗤𝗨𝗜𝗧𝗔𝗦 𝗯𝗲𝗰𝗮𝗺𝗲 𝗮𝗻 𝗲𝘅𝗰𝗹𝘂𝘀𝗶𝘃𝗲 𝗺𝗲𝗺𝗯𝗲𝗿 𝗼𝗳 𝗦𝗜𝗣𝗔𝗖 𝗶𝗻 𝗞𝗮𝘇𝗮𝗸𝗵𝘀𝘁𝗮𝗻 It is a great honor for us to announce that 𝗔𝗘𝗤𝗨𝗜𝗧𝗔𝗦 has joined the Sino International Professional Advisory Council (SIPAC) #global platform as an #exclusive member in #Kazakhstan. SIPAC was formally launched in March 2023 and held its inaugural Sino-International Law Forum in Shanghai in November 2023. SIPAC and its comprehensive ecosystem of channel partners, including key quasi-governmental inhouse counsel associations and leading outbound investment think tanks, #legal know-how publishers and legal training platforms, are uniquely positioned to help promote the development of China’s #international legal infrastructure, a key initiative promulgated at all levels of the Chinese government. As such, SIPAC is designed to address the entire #China legal services market, including all in-house lawyers responsible for international legal affairs, as well as lawyers in Chinese #law firms engaged in cross-border legal matters on behalf of their Chinese clients.
