You could, in theory, put any type of document on the trace:original application if you need to prove ownership, possession, or transfer digital documents. Banks and corporates are now entering a hybrid environment, where depending on jurisdiction, fully digital trade may be possible."     How do you know if a system is reliable in line with MLETR? At Enigio, we’ve certainly faced our fair share of this question over the years... While reliability is a cornerstone of MLETR (Model Law on Electronic Transferable Records) and related legislation, such as the UK Electronic Trade Documents Act, what qualifies as a “reliable” method or system has been unclear to the market. At Enigio, we’ve had to create our own evidence and explanations to address this uncertainty, awaiting the development of an official assessment framework for MLETR reliability. When we created trace:original, our initial focus was to comply with the Swedish promissory note act from 1936. After 2019, when MLETR was introduced to us by our friends at InterPARES Trust, it became the blueprint for everything we do. Our goal from the start was to create “digital paper” that kept all good qualities of paper and added all digital potential with it. Our team of banking experts, technical specialists, legal experts and researchers has consistently referred to MLETR as a guide when adding new features or functions. It has served as both a functional and legal specification for trace:original since 2019. Communicating the depth of this effort to the market has not always been straightforward. That’s why we were thrilled when the ICC Digital Standards Initiative (work led by Pamela Mar) in cooperation with the Digital Governance Council of Canada (work led by Tim Bouma) set out to develop an official assessment framework to help the market assess MLETR compliance and reliability. At Enigio, we were more than happy to support this critical initiative. We very much appreciate the effort made by ICC DSI and DGC in making this framework a reality! I’m really happy to have been part of the expert workgroup that helped develop this framework—and perhaps even more proud that Enigio trace:original was the very first solution to be verified as reliable under the framework after its release in October 2024. For those involved in digital trade, this framework is an invaluable tool for assessing and ensuring MLETR compliance in chosen solutions. By leveraging it, stakeholders can build trust, reduce uncertainty, and accelerate the adoption of reliable digital trade systems. Make sure to explore it!
