STØRRE RETSSIKKERHED MED INSTITUTIONEL VOLDGIFT. Måske kender du begrebet den italienske torpedo. Det ironiske ordspil dækker over det forhold, at det kan være håbløst at forfølge en kommerciel tvist i visse lande eller indlede en retssag i et land med høj korruption. Men er der også fare for en dansk torpedo, spørger Thony Lindström Härdin, som peger på institutionel voldgift som et effektivt middel til at øge retssikkerheden for virksomheder i Norden. I sin analyse skriver han blandt andet, at sagsomkostninger er mere forudsigelige i institutionel voldgift. "Det gælder naturligvis til dels voldgiftsdommernes honorarer efter de faste takster, som en part let kan indtaste og beregne på institutternes hjemmesider. Vi oplever desuden større forudsigelighed med hensyn til advokatrepræsentation, som udgør den største omkostning i forbindelse med en tvist. Med en klar tidsplan og afklaring fra begyndelsen i forhold til, hvor mange skrifter der skal indsendes, bliver advokaternes projektledelse bedre. Teamet har sagen friskt i erindringen, ligesom der er færre risici for personaleudskiftning under en tvist med en forudsigelig tidsplan. De tvister, som vi konstaterer, er blevet dyrere end planlagt, er primært retssager ved domstolene, hvor modparten i højere grad har frihed til at trække tiden ud og forfølge en uhensigtsmæssig processtrategi med fremlæggelse af beviser og anbringender sent i processen. Dette er tendenser, der kan undgås selv i en ad hoc-voldgift, men uden et klart regelsæt er tvistløsningen dog afhængig af, hvem voldgiftsdommerne er." Swedish corporates most settlement-friendly in the Nordics - Danish least The annual publication Roschier's #DisputesIndex covers a wide spectrum of statistics from the #Nordic disputes market. One is the pre-judgment settlement rate amongst Nordic corporates, displaying: ✅ Swedish companies record the highest settlement rate in the survey (76 %) ✅ In contrast, Danish companies settle the least (37 %) ✅ Finland (50 %) and Norway (58 %) are placed between the two extremes ✅ Since inception of the index in 2014, Danish companies have noted a sharp decline in settlement rates, whereas the other three Nordic countries have remained rather stabile The statistics align well with Litigium Capital’s portfolio of concluded investments, with a settlement rate of 86% of all concluded cases since inception in 2020 Link to the survey: https://lnkd.in/ds4KXEdh #thirdpartyfunding #litigationfunding #legalfinancing #disputes 📷Nico BHLR
