The Sentencing Advisory Panel (SAP) has just issued a new guideline on sentencing scam-related cases. I gave some brief remarks to The Straits Times with my take on the new guidelines. One of the trickiest things in sentencing is figuring out how to bridge the qualitative - quantitative gap. Judges and lawyers know they have to apply principles like deterrence, retribution, protection and rehabilitation, but how do these translate into a specific number of weeks' or months' imprisonment? The guidelines help a lot with this, nailing down indicative starting points for common types of offences. This helps lawyers and judges by giving them a common starting point from which to reason. This is a bigger deal than it might seem, as lawyers sometimes end up talking past each other if they don't have common premises to start with. At Parliament today, I addressed several questions related to CrowdStrike. Understandably, due to the interconnectedness of IT systems around the world, some Members have raised questions about how we can ensure the resiliency of our systems and how outages like these may impact public confidence. Indeed, public confidence in our digital systems must not be taken for granted. To achieve public confidence, I emphasised that there are no shortcuts. This means that all stakeholders in the ecosystem must implement appropriate measures to ensure the resiliency of our systems. Importantly, when disruptions occur - and they inevitably will, given the interconnectedness and breadth of our digital activities - systems must be recovered quickly. There can be a marked difference in the user perception of the reliability of a system depending on the length of the outage. On the Government’s end, we have always adopted a risk-based approach, holding Critical Information Infrastructures (CIIs) and essential service operators to the highest level of accountability. Under the Cybersecurity Act, CIIs are required to meet baseline security and resilience requirements, including conducting timely risk assessments and audits. Under the Cybersecurity Code of Practice, CII owners must adopt, to the extent possible, the “defense-by-diversity” principle. This means that, as far as possible, CIIs must build in different system architectures, communication pathways, and use different vendors for hardware and software, to prevent a disproportionate vulnerability to specific attack vectors. Additionally, the Cyber Security Agency of Singapore (CSA) has established the "CII Supply Chain" Programme, which provides system owners with a toolkit to assess and rate their cyber supply chain risks using a standardised vendor management methodology. Our upcoming Digital Infrastructure Act (DIA) seeks to further enhance resilience within the cyber system. We will be releasing more details on the DIA in due course. For businesses, I stressed the importance for them to consider the impact of outages on their reputation and customers. It is always in businesses' interest to look after their customers. To do so, businesses can utilise the resources provided by the Singapore Government, such as CSA's cybersecurity toolkits and IMDA's SMEs Go Digital Programme. Let’s all work together to strengthen our digital resilience. By fortifying our systems and putting in place good business continuity plans, we can maintain public confidence in our digital systems. - Jo Teo
