Thawee Sodsong, Minister of Justice, led a delegation of senior officials from the Ministry of Justice to pay a courtesy visit to Mrs. Chanakarn Theeravechaphonkun, President of the Supreme Court, to discuss various official matters. These included the management of drug offenders placed under probation as per the intent of the Narcotics Code and strengthening collaboration between relevant organizations for the efficient delivery of justice. The visit included senior officials from the Ministry of Justice, such as Suriyapong Tubtimtae , Director of the Thailand Arbitration Center (THAC); Mr. Traiyrit Temahiwong, Deputy Permanent Secretary of the Ministry of Justice; Mrs. Jirapha Sinthunawa, Deputy Permanent Secretary of the Ministry of Justice; and Pol. Lt. Suriya Singhakamol, Deputy Permanent Secretary of the Ministry of Justice. The discussions took place in the reception room on the 2nd floor of the Justice Court building in Phra Nakhon District, Bangkok.     📌 THAC Managing Director Pays Courtesy Visit to Attorney General to Discuss Justice System Cooperation On October 7, 2024, at 2:00 PM, Mr. Suriyapong Tubtimtae ,Managing Director of the Thailand Arbitration Center (THAC), paid a courtesy visit to Mr. Pairat Ponsomboonsiri, Attorney General, at the Attorney General’s reception room, 9th floor, Ratchaburi Direkrit Building, Government Complex, Chaengwattana Road. The purpose of the visit was to discuss cooperation in the justice system and the promotion of arbitration for dispute resolution. This meeting was also attended by Pol. Col. Tawee Sodsong, Minister of Justice Thailand, along with Mrs. Pongsawat Neelayothin, Permanent Secretary of the Ministry of Justice Thailand, and other key officials. The main objective was to foster cooperation in promoting access to justice and alternative dispute resolution (ADR), which is a crucial mission of the Office of the Attorney General and the Ministry of Justice Thailand.     National Economic and Social Development Council (NESDC) Joins Discussions with the Thailand Arbitration Center on APEC Online Dispute Resolution Framework On October 3, 2024, the National Economic and Social Development Council (NESDC) joined discussions with the Thailand Arbitration Center (THAC) regarding the Opt-in mechanism for the APEC Online Dispute Resolution (ODR) collaboration. This initiative is a key APEC project aimed at promoting cross-border online dispute resolution for micro, small, and medium enterprises (MSMEs) to resolve business-to-business (B2B) disputes swiftly and efficiently. The meeting was held at the THAC’s hearing room and was attended by representatives from NESDC, including Mr. Thatchthai Keeratipongpaiboon, Director of the Strategic and International Cooperation Division; Mr. Pittawas Jirathitiwong, Senior Policy and Plan Analyst; and Mr. Wallapat Nakbua, Policy and Plan Analyst.     THAC Signs MoU With SAGE MEDIATION On October 3, 2024, the Thailand Arbitration Center (THAC) and SAGE MEDIATION signed a Memorandum of Understanding (MoU) at the THAC headquarters in Bangkok. The ceremony, held from 12:30 PM to 1:30 PM, marked the beginning of an important collaboration between the two organizations aimed at promoting academic cooperation and enhancing alternative dispute resolution (ADR) operations. The MoU was signed by Mr. Aloysius Goh, Chief Executive Officer of Sage Mediation and Mr. Suriyapong Tubtimtae, Managing Director of THAC Thailand Arbitration Center (THAC). The cooperation focuses on a variety of initiatives, including seminars, academic conferences, personnel development, and other activities related to ADR, with the shared goal of improving the accessibility and effectiveness of dispute resolution services. Ms. Pannapas Methinsasivich, Counsel of THAC, served as the Master of Ceremonies, warmly welcoming the distinguished guests. This case could set a precedent in the intersection of international sanctions and investment protection. Fridman's legal team is invoking a 1989 Soviet-era treaty that protects investors against expropriation, nationalization, or similar measures. The arbitration is requested under UNCITRAL rules, with Hong Kong proposed as the venue, which was strategically chosen to avoid potential bias from European jurisdictions. Luxembourg now faces a crucial decision on whether to participate in these proceedings, as non-participation could lead to a default judgment. This case highlights several critical issues: 1.) The potential conflict between EU sanctions and bilateral investment treaties 2.) The choice of arbitration as a tactical move to circumvent domestic courts 3.) The significance of selecting a neutral arbitration venue Javier Garcia Olmedo, senior counsel at Bonn Steichen & Partners (BSP), suggests this could be "a dress rehearsal" for similar cases, given the hundreds of treaties protecting Russian investors' interests. Implications for the future: • Potential for a wave of similar arbitrations by sanctioned individuals • Challenges for states in balancing international obligations and investment protections • Possible reassessment of longstanding investment treaties in the light of geopolitical shifts As this case unfolds, it will undoubtedly shape the landscape of international arbitration and investment law. With 282 arbitration institutions now established nationwide, the country is rapidly becoming a powerhouse in alternative dispute resolution. 𝐊𝐞𝐲 𝐡𝐢𝐠𝐡𝐥𝐢𝐠𝐡𝐭𝐬: • Over 5 million cases handled to date • Total case value exceeding ¥8 trillion or approximately $1.13 trillion • There was involvement of parties from more than 100 countries and regions This growth reflects China's commitment to building a credible and effective arbitration system. The country is not resting on its laurels, however. Efforts are underway to revise the arbitration law, aligning it with advanced international standards and enhancing provisions for foreign-related arbitration. In addition, the development of international commercial arbitration centers is also gaining momentum. In 2023 alone, eight pilot institutions handled 79,000 cases valued at ¥600 billion, showcasing China's increasing role in global dispute resolution. Looking ahead, China aims to further enhance the credibility of its arbitration system by: 1.) Improving operational mechanisms of arbitration institutions 2.) Strengthening oversight of both institutions and personnel As the global arbitration landscape evolves, these developments in China present both opportunities and challenges for international businesses and legal practitioners.
