About us

The African Court on Human and Peoples’ Rights (the Court) is a continental court established by African states to ensure the protection of human and peoples’ rights in Africa. It complements the functions of the African Commission on Human and Peoples’ Rights. The African Court is the judicial arm of the African Union and one of the three regional human rights courts, the others being the European Court of Human Rights and the Inter-American Court of Human rights. It was established to protect human and peoples’ rights in Africa principally through judicial consideration of human rights complaints. The Court’s permanent seat is in Arusha, the United Republic of Tanzania. The Court was established pursuant to Article 1 of the Protocol to the African Charter on Human and Peoples’ Rights on the Establishment of an African Court on Human and Peoples’ Rights, (the Protocol) which was adopted by Member States of the then Organization of African Unity (OAU) in Ouagadougou, Burkina Faso, in June 1998. The Protocol entered into force on 25 January 2004. To date, 34 Member States have ratified the Protocol establishing the Court. Out of these, currently, only 8 States have filed a Declaration under Article 34 (6 ) of the Protocol by which they accept the competence of the Court to consider applications filed by individuals and NGOs.

The African Charter on Human and Peoples’ Rights [https://ow.ly/C2pu50TPzTt] is one of the human rights instrument that is widely cited not only in large number of continental legal and policy documents, but also in national and sub-regional instruments. #AfricaHumanRights Along with other human rights instruments it inspired, the African Charter continues to serve as source of inspiration in the 𝐞𝐥𝐚𝐛𝐨𝐫𝐚𝐭𝐢𝐨𝐧 𝐨𝐟 𝐧𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐛𝐢𝐥𝐥𝐬 𝐨𝐟 𝐫𝐢𝐠𝐡𝐭𝐬 𝐚𝐧𝐝 𝐯𝐚𝐫𝐢𝐨𝐮𝐬 𝐥𝐚𝐰𝐬 giving effect to specific human rights. It is equally iconic in its contribution to the corpus of international human rights. Reaffirming the principles enshrined in the African Charter, member states have over the years adopted several other legal documents to supplement it in building the legal framework of the Organization. The Protocols cover a broad spectrum of human rights including civil and political rights; economic, social and cultural rights including the right to development, they include; 1. The Protocol to the African Charter on Human and Peoples’ Rights on the establishment of the African Court on Human and Peoples’ Rights. 2. The Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Women in Africa. 3. The Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Older Persons in Africa. 4. The Protocol to the African Charter on Human and Peoples’ Rights on the Rights of People with Disability. Moreover, to expand the scope of its instruments to complement the Human rights Charter and tackling political dimensions that indeed affect human rights, the following instruments have been adopted; 1. The African Union Convention on Preventing and Combating Corruption. 2. The African Charter on Democracy, Elections and Governance (ACDEG). 3. The African Union Convention for the Protection and Assistance of Internally Displaced Persons in Africa (the Kampala Convention) 4. The Protocol to the Treaty Establishing the African Economic Community Relating to Free Movement of Persons, Right of Residence and Right of Establishment. 5. The Statute on the Establishment of Legal Aid Fund for the African Union Human Rights Organs. The Legal Aid Fund is yet to be operationalized. Despite these elaborate policies and efforts by the African Union and its Organs, the challenges on the continent around human and peoples’ rights still exist. The challenges stem from the aftermath of colonial exploitation; issues of state sovereignty; weak enforcement and accountability measures, limited resources for effective implementation of the human rights standards exacerbated by conflicts, corruption, competing priorities at the domestic level, among others. 🌐Learn more about #HumanRights in Africa on https://ow.ly/3taq50TPzTs

The 𝐀𝐟𝐫𝐢𝐜𝐚𝐧 𝐂𝐨𝐮𝐫𝐭 𝐨𝐧 𝐇𝐮𝐦𝐚𝐧 𝐚𝐧𝐝 𝐏𝐞𝐨𝐩𝐥𝐞𝐬’ 𝐑𝐢𝐠𝐡𝐭𝐬 has jurisdiction over all cases and disputes submitted to it regarding the interpretation and application of the African Charter on Human and Peoples’ Rights, the Court’s Protocol and any other relevant human rights instrument ratified by the concerned States. 𝐖𝐡𝐨 𝐜𝐚𝐧 𝐦𝐚𝐤𝐞 𝐚𝐧 𝐀𝐩𝐩𝐥𝐢𝐜𝐚𝐭𝐢𝐨𝐧 𝐚𝐭 𝐭𝐡𝐞 𝐂𝐨𝐮𝐫𝐭? 𝟏. The African Commission on Human and Peoples’ Rights; 𝟐. A State party to the Court’s Protocol against which the complaint has been lodged at the Commission; 𝟑. A State party to the Court’s Protocol whose citizen is a victim of a human rights violation; 𝟒. African Intergovernmental Organisations; 𝟓. State parties to the Court’s Protocol with an interest in a case may be permitted by the Court to join the proceedings; 𝟔. NGOs with Observer Status before the Commission, and individuals can institute cases directly before the Court, if the State party from which they come from has made a declaration allowing such direct applications. The Court gives its 𝐣𝐮𝐝𝐠𝐦𝐞𝐧𝐭 𝐰𝐢𝐭𝐡𝐢𝐧 𝟗𝟎 𝐝𝐚𝐲𝐬. Its judgment is final and not subject to appeal. However, in light of new evidence, which was not within the knowledge of a party at the time the judgment was delivered, a party may apply for review of the judgment.   • The Judges of African Court on Human and Peoples' Rights and the International Court of Justice (ICJ) are engaging in a two-day virtual exchange to share insights and expertise. The forum will specifically explore the intersection of International Human Rights Law #IHRL and International Humanitarian Law #IHL, fostering deeper understanding and collaboration among the two Courts. The Judges will also concentrate on exchanging the specialized knowledge needed to address the unique legal challenges that arise in #humanrights cases during armed #conflicts. Through this interaction between the Judges, the two Courts hope to strengthen the global commitment to justice and human rights for all as they jointly tackle challenges in today's global justice landscape.   • Le deuxième dialogue judiciaire tripartite, placé sous le thème "renforcer la coopération entre les Cours régionales et sous-régionales en Afrique" a débuté sur une note positive avec des echanges fructueux. The Dialogue judiciaire a réuni les cours sous-régionales que sont la Cour de Justice de la Communauté CEDEAO et la Cour de Justice de l'Afrique de l'Est; et la cour regionale qu'est la Cour africaine des droits de l'homme et des peuples. Ce diaologue vise le renforcement de la coopération entre ces cours et leur apportera des avantages certains, en ce qui concerne la distribution de la justice en Afrique. Le dialogue judiciaire tripartite est une cadre d'échanges permettant d'aborder des questions d'intérêt commun, de rechercher des solutions idoines communes, y compris dans la gestion des procédures judiciaires, la jurisprudence et, de manière générale, dans l'administration de la justice. En outre, à travers ce dialogue, les juges des trois cours ainsi que les représentants des institutions partenaires et ceux des organisations internationales sont résolument engagés à débattre des défis et opportunités des différents systèmes judiciaires en Afrique. L'heureuse collaboration des trois cours a, par le passé, favorisé un dialogue riche, pouvant facilier la coopération judiciaire Au cours du dialogue judiciaire, seront abordés différents sujets relatifs, notamment au droit à l'éducation, conformément au thème de l'Union africaine pour l'année 2024, au droit à l'environnement, au financement des juridictions internationales.
